As soon as someone uses the level that an ADAS system is approved to operate at rather than how it actually performs in the real world, I know they are not serious about appraising the actual performance of the system.

LiDAR indeed not needed for Level 3 and above. Teslas FSD is the only system close to Level 5 and like humans does not need it.
