Yup. I find I can even wear a hat with the seat positioned properly. As long as the camera can see your eyes looking at the road you're all good. I even rest with my hands behind the headrest, it never nags me about that.

You can do that now, just hold your phone up so you're still looking at the road. I see nothing wrong with that as long as you're ready to supervise and don't get locked in to your phone.
