I think there could be an issue with punishing the buyer. They never signed a contract or agreement that said they wouldn't buy a CT that wasn't a year old.

That's why it's worded this way - any buyer is a third party, can't be held to the deal Tesla's customer took. They get to keep the truck (and take the risk Tesla refuses to deal with them later), So it piles all the risk onto the flipper.

And the penalty isn't greater than the value of the truck, which eliminates the other lever to break the contract with.

It seems pretty well written, from my layman's view.

Hasn’t Tesla done other things, like denying charging? That would be a huge deterrent for me.
I would think this would deter pretty much everyone. Losing the ability to supercharge... that's a dealbreaker.

Seems like this needs a poll... assuming the no resale / buyback provisions are real, do you like it, hate it, does it change your intent to purchase?
I think you missed an important bucket

it’s the bucket corollary to “I'm probably still buying but I DO NOT LIKE the no resale provision”

this missed corollary goes something like:

“I’m possibly not buying, with this resale provision giving me serious pause”



Ultimately, everyone here saying they’re buying and the provision makes sense are talking out of their a**es:

you don’t know the Cybertruck price (or all specs/features), nor when in time you’ll be asked to sign this provision

if the CT is released without key features you “need,” and/or at a budget-stretching price, you may start to care about this restriction on your ability to act as a rational player in the market.

Similarly, near-sighted are the people whose number won’t be called until into the second year of Cybertruck sales.

when THEY are asked to sign this no-resale provision, OTHERs who have had the truck for over a year will begin selling in the secondary market. If they’re selling in the secondary at a premium, the no-Resla provision means Tesla is making you sign up to take a low-ball amount for your truck. If the CTs aren’t selling at a secondary premium, it means Tesla is doing it for no reason.



Tell me the truck’s price (and features), and the date on which I’ll be asked to sign this re-sale agreement, and only then can I (or anyone) legitimately answer this poll.

What on earth are you talking about? Real post, real poll, that I thought would do a good job of taking the pulse of the CT buyer community here wrt the no resale provision.

My stance is a little different. Here’s why, I am a very early res holder (within the first 2k), not even sure if That matters anymore (bummer).

since my reservation/deposit a lot of things have possibly* changed in the negative for my use case.

1) rumors seem to be indicating the range will not meet what was initially promised.
2) the payload is lower than initially promised.
3) the cargo capacity is lower than initially promised
4) the tailgate ramp seems to be gone.
5) the frunk is drastically smaller and seems to lack outlets and additional functionality.
6) tow capacity appears to be less.

when I first reserved this truck I was sold on the idea that it would be a badass capable work truck to defy the narrative that EV’s aren’t capable, and it still can be. But it seems like Elon and the design team scrapped that way of thinking and decided to instead make a more practical truck for what most people use them for. Driving around town, getting groceries, taking the kids to practice etc. for everyone who saw the initials size and specs in comparison to what we see now are you more or less excited for it? For me it’s less. But that’s because once again I wanted a heavy duty work truck. Now just because the truck wont be good for ME doesnt mean it wont be a good truck.

so I will hold my reservation until and HOPE that what we have heard in the rumor mill for my key factors.

If not then sadly I may need to shop for a diesel truck which I really didn’t want to do.
where I think the 1 year hold policy is wrong is the fact that why does Tesla get to hold all of our money for years on end make interest or investments. But we can’t be rewarded for our early investment into the truck if it doesn’t live up to what was initially promised.

imagine your a person with an early reservation you get the truck. You hit a bad turn of events lose your job Or fill in the blank with xyz scenario. Now your only option is to surrender the truck back to Tesla at a loss? That sounds fun right. Your out the taxes, the reg fees and your paying for the mileage. Vs potentially private resale to atleast recoup some of your losses maybe even make a small profit to help support and sustain your family in these times.
If Elon is really a free market capitalist I think it would be more appropriate to let whatever happens happens it’s not right for him to have it both ways. By the pole it seems there aren’t to many flippers anyway. If I am buying something then I should OWN IT and have the right to do whatever the hell I want with it.

It's true that no one has actually purchased a Cybertruck yet, so the final wording is unknown. But this verbiage is not "fake", it is out there, right now, in documents directly from Tesla.
