"We reviewed your specific request and respectfully disagree that your reasoning for needing to sell your Cybertruck warrants an unforeseen circumstance that would trigger Tesla’s purchase of your Cybertruck. To be clear, Tesla will not purchase your Cybertruck from you and because there was no unforeseen circumstance, you are still bound by the one-year prohibition to selling your Cybertruck privately as detailed in your Motor Vehicle Order Agreement."

They are unlikely to purchase it back for any reason other than a change in financial situation that prevents you from affording it.

Tesla cannot obligate you into financial ruin. If you can't afford the truck and need to sell it, tell them. Your made up reason for quality is invalid.

Yes I agree. Simply explain the actual unforseen circumstance that you stated to us, which is that you cannot afford it.

They have made themselves accountable by creating the contract that binds them to the buyer's financial capability of paying for it, and providing the option to sell it back for a "reason [that] warrants an exception".

TESLA said:
Notwithstanding the foregoing, if you must sell the Vehicle within the first year following its delivery date for any unforeseen reason, and Tesla agrees that your reason warrants an exception to its no reseller policy, you agree to notify Tesla in writing and give Tesla reasonable time to purchase the Vehicle from you at its sole discretion and at the purchase price listed on your Final Price Sheet less $0.25/mile driven, reasonable wear and tear, and the cost to repair the Vehicle to Tesla’s Used Vehicle Cosmetic and Mechanical Standards

A lot of people bought to flip, more bought to flip when they saw one sell for 200k. But the demand for anything over retail has slowed and each day there are more listed and prices drop. Week or two from now they will be 120k or less.

Everyone that buys a FS is going to get record level depreciation over the next 12 months. The fact the resale price dropped 50% in two months is pretty good proof of this fact. Anyone buying should want the truck for their own enjoyment and know they'll be taking a huge hit when they decide to resell.

If I get my Beast in late 2024, I assume that it will be worth $20k less than I paid for it the day I drive it off the lot.

I think that is a good way to look at it. CT and especially FS CT are not investments, at least not anymore. Fun second vehicle and a blast to drive on the weekend around town, but not a way to profit or store equity.

So here's the run down; I need the money and submitted a request through Tesla to buy it back with a reasoning of "unsatisfied with Cybertruck quality". That request got denied and from what I am interpreting, I can't even sell it back for the price I purchased it for. (My intent is not to profit, but break even). Any advice on how I can proceed because I do need the money as much as I love the truck but seem to be stuck both ways..

5 new cybertrucks listed on just cargurus in the last two days, is one of those yours?

Bankruptcy in the US is primarily caused by medical bills, which were initiated by a contract.

Hope this guy can get out from under his truck, either to Tesla or someone buying.

Contracts have to have benefits for both parties. Tesla is the only beneficiary in this one. Anyone can sue for anything but will it hold up in court? no. A contract is a contract but doesn't make it legal or enforceable. If they said sign this and if you sell your truck, we remove a toe, not enforceable. I've seen 100's of these trucks re-sold, I have neard of ZERO lawsuits from Tesla over it. I think if you made the offer to let them buy it back and they declined, then sell it.... "Damages" in their agreement mean nothing, there are no damages for them to collect... It's a clause to scare flippers, which as you see, is scaring everying. If you can't afford it, Sell it and move on, the worst they can do is ban you from buying from them again and THAT has been done to only 1 person that i've seen.

Think the number of CTs resold has to be over 300 now between auctions, dealer listings, etc. Have heard of one second hand unverified case which Tesla banned someone from buying future vehicles.
