then you don’t know how much businesses spend litigating. It’s a lot. not like they’re gonna go broke but efficiency is important and bean counters want these things resolved quickly and cheaply it’s a cost of doing business.

also you’re misreading/misinterpreting a little bit what I mean about “cost.” It isn’t that they can’t afford it it’s that if it cost less to settle then to continue to litigate then you settle. Jury trials are uncertain. If I have a dollar amount that I know I’m going to spend I can wrap that one up and move onto the next one.

Here’s what I know. I’ve been a litigator for 22 years and this type of work is what I do. And I represent clients exactly like this. I have litigated these exact type of cases. The vast majority of them settle. Even on the eve of trial even during trial for various reasons and they are always economic.

No one settles because they are afraid of the the process. Plaintiff’s counsel, if they were not at the top of their market would have brought in the best lawyers that they could in their market. Tesla’s defense guys know exactly what they’re doing. We’re litigation lawyers we love to fight (isn’t that fucking obvious from my posts?)

I promise you, the defense council wanted to go forward and something happened to make it imprudent economically. Again not fear of a big verdict, not fear of public disclosure of their IP because that would never happen it would be protected anyhow even in a judgment. It made dollars and cents. That’s it!

And again my speculation is that the plaintiff folded because it made sense for them to do it. Whether they ran out of money for the defense or as I stated more probably they were going to get fucked because of something to do with fear of not beating the tender.

99.9% chance Tesla settled as a matter of PR. It's not a good look for any Fortune 500 company to slam dunk on someone in court when they just buried a family member.

Proprietary information wouldn't have been divulged anyway; that info is protected by law.

Agree. There is a very fair Edison comparison here that @REM is definitely not going to concede, but should.
Elon is truly the Chief Engineer at SpaceX and has a crazy amount of mastery level knowledge on this subject. Maybe you guys don't nerd out on this stuff like I do, but he really does fill the shoes here.

Comparing him to Edison is a cheap shot I think.

I’m telling you that’s not what happened. They settled because it became economically prudent to do so. There are zero other reasons.

These decisions are made by risk managers and in-house counsel; not PR people. Once it’s in litigation two things drive the decision-making: (1) Mitigation and (2) if it all possible, avoiding making bad caselaw.

This was a run of the mill products liability case irrespective of what it seems like because of the involvement of driver assist technologies - remember this is not an FSD case it wasn’t available!

Tesla has insurance for this stuff. They may have a high retention (meaning they’re paying a fair amount of it out of their pockets up to a cap - sort of like your deductible) but at some point underwriters come in and decide how much of their money they’re willing to spend, and going through a trial is always more - with an uncertain outcome. Bean counters do not like uncertainty. When we walk away from a negotiated settlement you know exactly what you’re spending.

This doesn’t work the way you guys are thinking it does. This and variations of it are what I do every day. 100% this was a financial decision.
