As a shareholder, I want people to get their $100 reservation back any time, but not if the $1000 if they built the truck online, including the FS package, agreed on the price and hit submit. TESLA uses these orders for production and planning and would be harmed if people cancel. The people with the $100 reservation should be able to wait and be first in line for a nonFS CT if they don't want to pull the trigger on FS right now.

And your point is? We’re not talking about failure to pick up the vehicle we’re talking about charging a fee for early access and then not providing early access. I paid $1,000 for something Tesla didn’t deliver.

Order Process; Cancellation; Changes. After you submit your completed order, we will begin the process of preparing and coordinating your Vehicle delivery. At this point, you agree that any paid Order Fee, Order Deposit and Transportation fee have been earned. If you cancel your order or breach this Agreement and we cancel your order, you agree that we may retain as liquidated damages the Order Fee, Order Deposit and Transportation Fee, to the extent not otherwise prohibited by law. You acknowledge that the Order Fee, Order Deposit and Transportation Fee are a fair and reasonable estimate of the actual damages we have incurred or may incur in transporting, remarketing, and reselling the Vehicle, costs which are otherwise impracticable or extremely difficult to determine. If you make changes to your order, you may be subject to potential price increases for any pricing adjustments made since your original Order Date. Any changes made by you to your Vehicle Configuration, including changes to the delivery location or estimated delivery date, will be reflected in a subsequent Vehicle Configuration that will form part of this Agreement. The Order Fee, Order Deposit, Transportation Fee and this Agreement are not made or entered into in anticipation of or pending any conditional sale contract.

Interesting. That's not what mine says. Probably varies state to state. Mine lumps the 100 and 1000 together and just calls it an "order deposit." It's also not reflected in the total on the right.

Out of curiosity, if your order agreement listed $1,000 paid for a spare wheel and they didn’t provide it would you be okay with that?
Of course not. That would be a breach on their part. But you want to changed your mind. Totally different question.
My example was, I get a deposit to hold, then they walk away. That is what you are doing.
Here is $1,000 for my FSCT and then you say just kidding, I want an X. It does not work that way. Sorry. But a No is a no. Just because you said yes then no does NOT MEAN Tesla can be required to changed theirs.

Tesla is cancelling Foundation Series Cybertruck orders, and forcing people who ordered an FS Cybertruck to take delivery or lose their $1,000 deposit.

In November 2023, Tesla starting taking $1,000 deposits for a Foundation Series Cybertruck.
There are plenty of people that put a $1,000 deposit thinking they would get a non-FS Cybertruck.

Our petition is for TESLA to:

#1 Allow those people, who put a $1,000 deposit, to get put in the line to get a non-FS Cybertruck.
#2 OR convert to another Tesla Model delivery
#3 OR convert to Tesla Cash.
I'm just a little confused here. I recall my order very clearly stating that the 1000.00 deposit was non refundable. I wanted the truck so no big deal.

It was intuitively OBVIOUS to anyone that placed the additional $1000 deposit and signed the contract, that the money was to configure and order a FS Cybertruck. (PERIOD!) It was also clearly stated that this deposit would be "non-refundable".

Having said that, situations do change for a myriad of reasons someone that previously committed to buy the FS CT may now have changed their mind and no longer want a FS CT.
IMHO, Tesla has 2 choices here:

1) Hold to the letter of the contract, that is YOU either buy the FS truck or forfeit your deposit.

or,

2) In the name of "goodwill" and as a onetime COURTESTY, allow these deposit holders to apply the funds to purchase another TESLA vehicle, to include a NON-FS CT.

AS a stake holder in $TSLA I, would encourage the company to make the later choice. This is simply better customer service. To me selling these "wafflers" another TESLA vehicle is a win-win. I would add one caveat, if you now want a non-FS CT, you will have to get back in line.... your FS series deposit should not allow one to get a truck ahead of others that purposedly skipped the FS order opportunity.

So, why alienate a customer when there are other avenues? I hope TESLA buys YOUR goodwill with your deposit. ;)

I full on agree with @Kaz109 "... I don’t mean to be rude, but honestly, this is like dealing with a child right now. I have a hard time understanding someone who can afford 100,000 on a truck and doesn’t have this basic comprehension of business."

Did you even bother read what I posted?

Or do you simply lack the ability to comprehend? In the long run it is always better for a business to keep a customer. You have don’t give them the store, but simply treating someone with respect even WHEN they screw-up is huge.

Tesla does not need to refund the $1000 deposit, but not letting potential buyers use those monies to purchase another vehicle would be foolish. I bet you have never dealt with the public in your line of work.

Please re-read what I posted and get back to me.

I didn’t change my mind, in April I paid $1,000 for early access, I got my VIN a week or two ago at a time at a time when I could just go and order one for delivery in a week or three so there was no early access. If it was just a deposit which it appears to have been for some I’d be fine with it but my order agreement clearly states the $1,000 provides me something additional or it would be listed as order deposit.

I spoke to a Tesla rep today and confirmed that this rumor is true. I have an order on hold, not to game the system, but to wait for a cash deposit coming from someone who has agreed to buy a collector car from me that I had intended to sell to pay for my Foundation Series Cyberbeast. My order originally stated “October or later this year’, and that is the timeline I was working with. My order hold is due to expire at the end of the year, but I only need it to last for another week or two from today. It’s wrong for Tesla to tell you that your hold is good until a certain date and then change the date and say “buy now or else”.

That being said, I also asked the rep if I paid the amount in full through the Tesla app if I receive a VIN, but wouldn’t be able to pick up the vehicle in the 3 day deadline that we are now given at some delivery centers. He told me that it makes no difference. I’d still lose the $1000 deposit and my place in line. He couldn’t even make it clear that I’d get my $120K payment back, which was shocking.
