Other driver said she did not even see us.
What a dipshit. Apparently the other driver didn't even notice the road construction signs, and add to that, no insurance? License should be taken away and they should face jail time.

Advice:

1) hire a lawyer.
2) sue them for the value of FSD as well as diminished value.
3) ask your lawyer to request their cell phone usage records.
4) sue them for every damage your layer can think of, including garnishing wages and going after any and all personal assets to recover your losses.

This dickhead was very likely scrolling tiktok. We need to start cracking down super hard on these pieces of trash.
I will have to see if insurance is going to subrogate. Hiring a lawyer is still on the table depending on the settlement on the insurance end.

Suing might not be a financially viable option personally as the driver is 23 and was uninsured according to the State Trooper. Not sure what assets she would have available for damages.

Phone use while operating a vehicle definitely feels like an epidemic of sorts.

Might contact the DA's office but I have my doubts on whether they would want to spend time on this. Think the closest court would be in Lake Charles, LA.

We were visiting the in-laws and this happens. Nobody in our Cybertruck needed a Ambulance ride. Metadata shows that FSD swerved to avoid a secondary collision with the Honda Pilot in front.

Painful thing was FSD was purchased outright along with the 0% deal. Waiting on my insurance. Other vehicle is apparently uninsured.

Glad everyone in your CT is okay, as that's the most important thing.

I'm glad the CT turned to avoid hitting the Pilot in front of you, but a little disappointed it didn't go right or avoid the collision completely!

35 yrs ago I got hit in the rear on the Eisenhower expressway in Chicago. Right lane was backed up exiting. The woman who hit me had just picked up a rental car, and was rubbernecking another accident on the side of the road! Yep, doing in excess of 55mph and never hit the brake.

I happened to be looking in my rear view mirror, saw her coming, turned my steering wheel right towards the breakdown lane, when I got hit. Not enough time to hit the gas. It was so hard, the stereo flew out of the dash and into the back seat.

I was in a Saab 900. My neck got whiplashed good. Her rental car was destroyed, she was fine. My Saab's rear bumper was connected to her car, and the trooper had me drive my Saab forward to disconnect us. The rear hatch was slightly displaced and the bumper cover was damaged, but you could barely tell I had been hit. My front bumper on the left side was bent because I had been pushed into the Cadillac in front of me. Only on the left because I had turned my steering wheel and was trying to get out of the way.

Now, I always look behind me when I slow. I was hoping the CT would be more proactive in avoiding rear-end collisions. I would prefer it go right into the breakdown lane rather than left into potential oncoming traffic. Oh well, can't have everything. Glad you and yours are okay. Be sure to get thoroughly checked out.

Edit: I just looked at the 2nd video again, and I'm not so sure it was the CT that turned to the left, rather I think the Mitsubishi that hit you was angled to her right, so hit you off-axis and pushed you to the left.

but the steering angle was -6° a fraction of a second before the hit, so maybe the CT was trying to get out of the way. Dunno.

I’m so sorry. So many people preoccupied these days. I am happy to know no one was injured. Wondering, did it warn you in any way that car was too close and/or coming too fast?
Thank you. Going to take time to get over this.

No red flashes or beeps at all. But surprised FSD was willing to start turning the wheel just before to avoid a secondary collision with the vehicle up front.

Definitely focusing more on my rear during situations like these to intervene via steering and/or honking if possible.

I'm sorry this happened to you. My condolences for your CT. I'm glad you're ok though.
Young and uninsured is hard to get a proper settlement as you mentioned. Perhaps they can garnish the other driver's wages until your portion is settled out? I've been in a few collisions myself, I'm 38, so I understand it's a really tough situation to be with (during, aftermath, and resolution). I wish you the best of luck with sorting everything out and hopefully there will be a used CT w/ FSD on sale for you to purchase. Will your insurance provide "New Vehicle Replacement" or current market value? Was it a FS or regular?

Interesting side data point, after the truck went into park, the accelerator went to 77%. I don't know of any other vehicles that shift out of drive after an accident to prevent inadvertent movement .
Another interesting note the flashers turned on the instant the hit occurred as well.

I know you think everyone in your car is ok but go to a chiropractor, have actually x-rays done (not hospital 'x-ray checks', useless).

I was 20 and was rearended at about 60 mph from an almost complete stop. I thought I was fine.
Years later I got smashed in the passenger side of the car spinning mine 180 (ironically an uninsured california driver...). I was almost unable to get out of bed a week later.
Found out I had an old weird tweak in the bottom of my back from something they couldn't explain. I told them about previous injuries/events and they said it made perfect sense for a high speed rear end collision. They said if I had dealt with it after the accident it would have been easy to fix. 15 years later though (among other things...) I spent 2.5 years doing chiropractics.
Ironically I was on my way back from a coast trip mountain biking, I didn't get on a bike for 2 years after that side swipe.

I tell everyone in an accident of any speed/impact to see a chiropractor just to make sure they didn't get tweaked!

Second this. Get properly checked over. I've also been there. I ended up not being able to sleep on my side due to shoulder bone micro fractures from the seatbelt, which meant I needed a CPAP machine.

I would also schedule a doctor visit and have even the smallest hint of soreness or injury documented in your medical history.

People need to learn extremely serious consequences from putting your life, and the lives of your family, at risk. Whiplash often shows up days or weeks later.

Retain salvage, transfer all the lifetimes. Part out the PCS and other components that are common pain points :ROFLMAO:

Almost appears to release brake right before impact to reduce force which is something I’m always prepared to do.
