Now if only the state of Nevada would certify them, they could go driverless in The Boring Company's tunnels.

Apparently not (or at least, not yet):
Company officials clarified that the new Level 4 certification applies strictly to Tesla’s commercial fleet operations and does not alter the legal status of the Level 2 Full Self-Driving (FSD) Supervised software currently used in customer-owned vehicles.

Yah, Tesla has to resolve how “unsupervised” claims will be handled - because when there’s only a computer driver, there has to be some sort of claim process that state insurance regulators and ambulance chasing lawyers can accept/use. Tesla could handle this by requiring owners to obtain insurance that subrogates all parties to the owner’s insurance, or they could require use of Tesla insurance on all vehicles. They could also simply insure all cars running on unsupervised FSD at the Tesla corporate level, with a much higher monthly FSD user fee. Ultimately the use of this software in an unsupervised manner will open the attorney community to filing suits against the title holder/owner, any passive driver, and Tesla corporate. Tesla would be the deepest pocket by far, so they have to resolve this before anyone gets unsupervised anything. It’s a very sticky legal wicket.
