Tesla is cancelling Foundation Series Cybertruck orders, and forcing people who ordered an FS Cybertruck to take delivery or lose their $1,000 deposit.

In November 2023, Tesla starting taking $1,000 deposits for a Foundation Series Cybertruck.
There are plenty of people that put a $1,000 deposit thinking they would get a non-FS Cybertruck.

Our petition is for TESLA to:

#1 Allow those people, who put a $1,000 deposit, to get put in the line to get a non-FS Cybertruck.
#2 OR convert to another Tesla Model delivery
#3 OR convert to Tesla Cash.
To get in line and in the back of the line of non-FS series. The 1,000 was for the FS series and it says on there non-refundable.
I disagree with #1, they can go to #2 or #3. Not going to cut in line in front of me. Lol

Which paragraph on your agreement talks about this 'early access fee' to get a cybertruck before one 'can go online and get one within a week or two'

'Some people are happy to roll over, accept whatever they're told' - No. Some people are honest and read and understand what they are signing before they submit a non-refundable deposit on a $100k purchase.

How does someone so dense that they cannot understand what a non-refundable deposit is and cry about losing $1k to save $20k even afford a $100k truck? This goes for the OP and the pain in the ass guy who claims to win in arbitration bc he's been in many lawsuits, mediations and arbitrations? You sound like a professional ahole.
Not sure what bit you don’t understand. If you pay for early access and don’t get it the only dense person is the one that’s okay with that.

So I have the set of tires that came on my CT in my garage and they have 30 miles on them. Willing to let them go for $1,000.

If you send me $50 and I pass by 10 others because you gave me a deposit and your commitment to pick them up on Saturday and you don't show ... the $50 is mine.
A perfectly cogent explanation of the ā€œopportunity costā€ which is one of the harms suffered by the seller from the type of breach of contract by the would-be buyer in this scenario. It is part of the liquidated damages that the agreed upon $1000 earnest money is intended to remedy.

Well done! It’s not rocket surgery. These concepts are PERFECTLY ACCESSIBLE to anyone willing to spend two minutes and apply two (functional) brain cells to thinking about it.

This is a receipt. Do you know the difference between a receipt and a written agreement (aka) a contract? Because you have a CONTRACT that contains the terms of the agreement to which you bound yourself.

And again for those of you in the back of this very tiny, very special bus - collateral sources neither constitute nor supersede the written agreement. That CONTROLLING DOCUMENT is to be construed by the terms contained within its four corners.

If you are picking up your Vehicle in a state where we are licensed to sell the Vehicle, we will notify you of when we expect your Vehicle to be ready for delivery at your local Tesla Delivery Center, or other location as we may agree to. You agree to schedule and take delivery of your Vehicle within three (3) days of this date. If you do not respond to our notification or are unable to take delivery within the specified period, your Vehicle may be made available for sale to other customers. For new vehicles, if you do not take delivery within fourteen (14) days of our first attempt to notify you, Tesla may cancel your order and keep your Order Fee.

I’d refer to the terms of the contract into which I willingly entered. Because I understand how contracts work.

That’s what I and Brian Boitano would do.

And your point is? We’re not talking about failure to pick up the vehicle we’re talking about charging a fee for early access and then not providing early access. I paid $1,000 for something Tesla didn’t deliver.
