insurance companies can subrogate if you know who the other person is, even their license plate, or date/time/location can be sufficient, however you would still have to eat the ding to your premium for filing the claim. It wont be as bad as if you were at fault but some insurance companies offer “accident forgiveness” and some cant change your rate mid policy unless you are at fault. Check with them but even calling and asking about it ive heard can affect your rate lol. Auto and homeowners insurance is a scheme against consumers.
Undoubtedly but most of us don’t have the capital to self insure

That's the weirdest thing I heard this year. Destruction of property is against the law regardless of where the property is located. I haven't checked all 50 states, but pretty sure it's universal nationwide. I mean it may not be a specific traffic offense because of the "private property", but the general criminal law still applies.

Here is the law for example for Oregon:

Because the damage is in excess of $1,000 this law kicks in, which is a FELONY, pretty bad mojo.
From what I remember here in Florida, your Drivers License is a permit, which means there are stipulations and responsibilities in place on the holder of the permit. This includes liability for property damage and injury. This is why driving off without calling the local Police is not the correct solution.

I know of a case where the offender met with the owner of a car she hit, and later found out that the owner filed a hit-and-run instead of sharing the information gained in the meeting with the offender, who was nice enough to find the owner of the car she hit. Talk about a mess. This is why you always call for at least a "Call report" with local PD.

Therefore, I totally agree with what you said above, as it makes sense and is probably in place in all fifty states in one form or another.

Thanks goodness for that B-Pillar recording coming in the new Tron update....maybe they'll eventually get that out to owners once Tron his DVD in 5 months...🤣

In all seriousness, sorry this happened, brutal when people are just utter piles of trash.

Totally agree. A police report is the way to go. Wish my local police force felt the same.

It's gotten so bad here in Florida, that our Florida Highway Patrol gave me a "self-report" form to handle the incident when I got "barely" hit on my rear bumper while sitting in traffic on the Florida Turnpike. I wasn't even moving, but the guy behind me hit me anyway while trying to change lanes.

I have several threads on here talking about how I've been hit three times already, always while completely stopped too. I've been rear-ended 9 times in Florida over about 35 years, three of which occurred in the CT in just the last 14 months.

It's getting to the point where I can pretty much tell when people are losing it in traffic, and I'll change my route to avoid incidents these days. Sunday evenings are by far the worst day to drive in South Florida, in my experience.

If you’re willing to pay out of pocket, just get a nice aftermarket one which would take an impact like that without more than a scratch or two 😝

My brand new CT with < 300 miles was backed into while parked at a shopping center, upon reviewing the sentry footages, the car drove off, license plate wasn't captured, it suffered front bumper damage + some fender scuffs, no official estimate yet but I estimated the repair to be around $3k (new bumper + fender cover + labor), I have Tesla insurance with 1k deductible on the CT, have been with them since they first started here in CA, never filed a claim, my question is, should I go through insurance risking premium increase or just pay out of pocket ?

That's why we need the fucking B pillar recording!! You should argue this with Tesla Insurance, because of this, now you are liable instead of the perpetrator.

Pay out of pocket, it will be very near your deductible, and savings in the long run. This would increase your premium.

To be sure, you can get a quote from a Tesla body shop for free.
