You're with many people waiting on the tax credit to come live for individual buyers. The seller "Tesla" needs to issue a notice on their end to the IRS at the time of sale. That is not happening. So you will probably not be able to get the credit next year.

Yes, my point is that TSLA is not ready. You can take the credit at POS or later.
Yes, for qualified vehicles submitted through the portal you can take the credit at sale or later.
However, you can't take the credit later if Tesla doesn't submit your purchase now. (Which is more likely due to ineligibility than paperwork)

I think they have too many unsold 2024 trucks at the moment. February will see

I was thinking they would want to incentivize deliveries for Q1 2025. Either get the EV tax credit rolling or a drop in price. Inventory looks to be filling up. Its just strange the IRS website says it is eligible but tesla saying it is not.

It's completely up to Tesla when to open it up. The EV credit can go away completely soon if congress repeals it.

As indicated above, the problem may be the unsold 2024s, which aren't eligible for the tax credit. The remaining 2024s could become very difficult for Tesla to sell, if 2025s were available with the $7,500 credit. Would you buy a 2024, if a 2025 was both newer and cost $7,500 less? Probably not, right? So Tesla may need to clear out the 2024s before they can offer the tax credit on 2025s.

Tesla is currently offering small discounts (less than $7,500) on 2024 non-Foundations, and free Supercharging on 2024 Foundation Series. But those incentives have apparently not cleared out the 2024s as yet. The Supercharging deal is set to expire on January 31, so maybe Tesla expects that all remaining FS will be gone by that point.

There is a risk that Cybertruck sales could stall out this month. Customers may be holding off on buying, until 2025s are available with the tax credit. But that means that they won't be buying 2024s. Someone needs to step up and buy those 2024s (without the tax credit) so that other people can buy the 2025s (with the tax credit).

That makes total sense. Seems like its only a matter of time for inventory to diminish for 24'.

Beast doesn't qualify, AWD with any non-FSD options doesn't qualify, and then there are the income limits.
So for some people/ trims, the only difference is the model year.

You're right -- some people don't care about the tax credit, either because they make too much money to qualify, or because they want a CT that costs too much to qualify. Those people might be happy to buy a 2024 non-FS at a slight discount, or a 2024 FS with Free Supercharging.

But we can safely assume that the tax credit does matter to some buyers. And the people who care about the tax credit could be putting their CT purchase plans on hold for now. This could cause sales to slow down, although they won't stall out completely.

Trump’s order, entitled “Unleashing American Energy,” also said his administration would terminate “where appropriate, state emissions waivers that function to limit sales of gasoline-powered automobiles; and by considering the elimination of unfair subsidies and other ill-conceived government-imposed market distortions that favor EVs over other technologies and effectively mandate their purchase by individuals, private businesses, and government entities alike by rendering other types of vehicles unaffordable.”

Language in the order and others issued by Trump on Monday indicate he is likely to seek to repeal a $7,500 tax credit for new EV purchases approved by Congress as part of Biden’s landmark 2022 climate law, as well as roll back Biden-era Environmental Protection Agency rules to tighten limits on greenhouse gas emissions and other pollution from passenger and commercial vehicles.

Link (thank you @ehua329 for providing) is clear on process https://www.irs.gov/credits-deductions/how-to-claim-a-clean-vehicle-tax-credit

Step 3: Get a time-of-sale report
When you take possession of the vehicle, the seller must give you a time-of-sale report and a copy of the confirmation the IRS provides when it accepts the time-of-sale report submitted through IRS ECO. This gives you:

  • Proof of your purchase's eligibility for the credit, the amount of the credit available for the specific VIN you are purchasing, and whether the credit was transferred to the dealer.
  • Confirmation that the dealer reported the sale to the IRS within the required 3-day period.
Step 4: If you didn't get a time-of-sale report: Contact your seller
If you do not have a successfully submitted time-of-sale report, you are not eligible to claim the credit.

Step 5: File Form 8936 with your tax return
You must ensure the seller has successfully submitted the Time of Sale report through IRS ECO to claim the credit.

Below is the part that seems to be misunderstood or completely missed by some people:

"If you do not have a successfully submitted time-of-sale report, you are not eligible to claim the credit."
