It's not legal per FMVSS 108 so Tesla, as a manufacturer, cannot install it on a yet-to-be-sold vehicle.

Can you quote the applicable sections?

It is my understanding that it is some state laws that don't allow them, not CFR.

Tesla installs them just doesn't hook them up. The owner has to connect the wires.
