I'm just plain curious is it complete FUD or will Tesla pursue Legal action to all those whom are selling their Cybertrucks for obscene amounts of money. I see this listing on Car Gurus and im just like, how is It possible already. did customers find loop holes to the contract?

Has anyone seen if the contract has changed again on the sale of the truck? For me its more of just understanding if Tesla will pursue and enforce or if this only helps promote the Truck through demand with no advertising dollars spent, yet again.

Nope, people are just selling the trucks, and so far Tesla has not done anything. Which further encourages others to do the same, so reselling and scalping is currently running pretty rampant.

Is that advice? Tesla is not dumb and they probably wouldn't want to take action until word gets out that the abuse is running rampant and everyone is wondering why they are doing nothing. Then they will step in and shut it down by clawing back the ill-gotten profits. And don't be misled by people without your best interests at heart, the contracts people signed said Tesla can do exactly that! Always go by what the contract actually says, not what you read on the Internet. Because it's your name on that contract!

But there are people willing to take the chance, if there is enough cash blinding them to the actual language in the contract. Just know that there is no way to do it without a lot of risk and downside.

It’s become painfully obvious in the` last decade that for about half of this country it’s ok to lie and cheat as long as you can get away with it. When you sign a contract that says no resale within a year and you fully intend to find a way to get around it that’s a lie. there is no point arguing with people who have no morals.

That's not how that works.

If you enter into a contract via lying, you are in breach of contract, which can be a criminal felony. Not to mention civil and contractual penalties.

I do not understand this thing where you defend liars with 'freedom'.

Tesla isn't dumb.

They're not gonna create (more) ill will toward their brand by actioning that clause for a couple hundred grand.

There aren't limited edition hand built vehicles like the gt40.

Unless you're defrauding the government or running pyramid scheme you're not getting a felony for breach of contract.

While I agree with your point that civilization relies on trust when it comes to contracts and agreements, the nuance here is the number of times we signed up to buy something with a feature Tesla said would work soon but they still have not pulled thru. My 2016 MS was supposed to drive itself within 2-3 years. Then in 2018, "oh sorry we abandoned that HW stack, but the revolutionary Model 3 will be able to do that"... that car came and went, and here we are 6 years later, robotaxi is still vaporware, and FSD is marginally better but with way more nagging than ever. So, Tesla can take that resell provision and stuff it where the sun don't shine. I'm happy to see some people getting their payday while a few rich peeps get a new CT on the quick. Free market! That said, I have no intent to transfer my CT to anyone else in the first year for any amount... I've waited too long for this!!!

Sigh...It would seem America has been dumbed down to the point that they can't even be bothered to read the contracts they sign.

Did you reserve a Cybertruck? You had to sign a contract between you and Tesla to do that. It outlines the terms of your reservation.

Did you configure/order a Cybertruck? You had to sign a contract between you and Tesla to configure and order a Cybertruck.

I suggest you read the contracts you signed. Tesla provides contracts that are written in plain language and quite short, simple, and easy to understand compared to most Purchase and Sale Agreements I've signed for new car purchases.

I sense we are going to have a bunch of people crying "no fair" when Tesla finally decides to hold buyers to the terms of the contracts they signed. The agreement was clear and concise, essentially amounting to a right of first refusal, but you can't fix stupid.

Why do people try to create false distinctions?

The contract doesn't say the Cybertruck is a hand-built, limited edition, it says if you want to sell it within a year, you have to give Tesla first stab at it or their will be contractual consequences.

It has nothing to do with whether it's hand-built or not.

You are incorrect, 100%. You have to read the clear, simple and concise contract you signed. You have never been able to purchase FSD without acknowledging that it is a development effort that may or may not come to fruition on the projected timelines, if ever.


So, Tesla can take that resell provision and stuff it where the sun don't shine.
You have every right not to enter into a contract containing provisions you don't agree with. But, then you can't buy a Cybertruck. It's the same story if you want to buy a house in a homeowner's association - you can't do it unless you agree to be bound by the terms of the homeowner's association. Nobody is forcing you to buy that house but, once you do, you are bound by the terms of the agreement.

Feel free to ignore the agreements you have signed, just know that the law will not be on your side when it comes time to enforce that agreement.

And know that it also comes with the potential of being blacklisted from buying any current or future Tesla products.

For what it’s worth. For those of us that signed a non disclosure days before the live reveal event at Tesla Austin, do we really know what we signed? We didn’t get a copy of what we signed. Yet it seems like all the social media people were live streaming the event and factory tour. So what exactly did the non disclosure actually say what we can and can’t disclose. How long is it good for? Does anyone have a copy of what they signed as it literally disappeared once we signed it with no way to copy it unless we took screen shots of every page before we went to the next page.

So I’m confused, are we suppose to have memorized word by word the Non disclosure or did it expire once we stepped into the factory as everyone was taking photos and lots were streaming it live.

Is that all thrown out the window like the no resale clause people are signing.

Heck where’s my offer to purchase a Cybertruck. I’ve got money in the game from almost day 1. Plus I took off 3 days of work, hotel, car rental, cowboy boots and cowboy hat. Not to mention my $72.00 BBQ Rib dinner. Am I just a Pawn? Not to mention my large share holdings.

Elon, speak to me. I work for lots of your celebrity friends. Wouldn’t you want to see a Cybertruck pull up in their driveways when I Arrive to save the day.
