Car dealerships in CA are not legally required to accept a POA.
Are they specifically excluded or do you think there needs to be legislation that says a particular type of business should accept POA ? My understanding is if someone has a general POA - every person / business has to accept that person as a legal representative of the person who has given POA. There doesn't need to be a rule that says coffee shops should accept POA, insurance companies should accept POA, book stores should accept POA etc.

They only have to accept it insofar as they have the ability to confirm it's real. They might not.

Well, if the owner calls and tells them (or using the app / email) that they are sending someone with POA - gives the agents name etc - then they just need to confirm the identity of the agent, right ?

If after all this - Tesla doesn't want to accept POA - they are deliberately trying to inflict as much pain on the customer as possible. Hows that for being better than a normal dealership.

Many companies don't accept POA. I know that is a hard thing to accept for many. There is no requirement to accept a POA. Remember this is a product being sold. This isn't one walking into the local DMV or City Hall. So get off the high horse that Tesla is being a hard ass. They just don't want to get burned. POA's are fishy business. Like come on. I had to file a flight plan to pick up my truck. So I think people can pick up the truck, or they are as I would say fishy if they cant. No reason for a POA. Maybe at delivery 124,554.

Like in the 500 deliveries of a cyber truck how many require a POA? My guess is none.

As an example, how hard is it to fake a Power of Attorney?
Easy to fake? Sure.

But anyone in the know would understand that you verify the PoA through the notary who certified it.

Do we really have to go there? I get the legal, but aren't we trying to just inform rather than fix the problems of the legal system?

Absolutely, let's go there. I love the Internet's ability to resolve or path out a highly vetted solution to complex problems. And do it quickly, with zero dollars spent. The vast amount of high value information just willingly added to forums is truly mind blowing.

I've been studying this topic as it related to Artificial General Intelligence for a long time now. Super interesting topic.

And there are a ton of high energy autists here just like me who love it too. That's why I spend so much time here lol

It's a forum and I'm just passing along the info I was given by multiple service centers. I don't care enough to research law precedent when I was repeatedly denied the usage of a POA for my own Cybertruck delivery.

Oh, in that case I'm far more inclined to believe that the service centers don't have the most legally correct info, or they have been instructed to just say no (for various reasons, of course). Functionally speaking, PoA's through corporations are exactly the same as individual citizen PoA's. And I don't see Tesla refusing to do business with other corporations lol.

Several states have explicit sanctions codified into law for businesses who refuse to honor valid PoA's without due cause. And I can think of several good reasons why this is an important protection.

Unless you have personally used a POA for your Cybertruck purchase in 2024, there's no reason to post unsubstantiated information. You are welcome to pay for a lawyer to tell you the ins and outs of the law and report back to us.
