At first I wanted to grant the driver some grace, as the road just before the hill was a passing zone.
They were actually in a no passing zone up until the crest of that hill. So when they would’ve started their overtake, they would’ve been in a no passing zone. They were still in the double lines the moment they swerved so they started that overtake way too early and blind.

Please allow me some healthy skepticism. This is most likely an edited CG/AI video made in an attempt to frame the innocent driver of a small SUV who was just minding his own business travelling in the correct lane of travel on a lovely day ... then Wam Bam Tesla CAM!

Of course the original undoctored video (OUV) known only to highly reliable people clearly shows the out of control, Autopilot driven, Tesla Cybertruck travelling at high speed (100mph?) and veering directly into the path of the victims vehicle. This is a coverup created and controlled by Lord knows who ... (maybe ELON :eek:) !!!

My takeaway is be afraid, be very afraid because Tesla is coming for you next!

It was definitely an illegal maneuver, in addition to being reckless and foolish.

If not for the swerve, the mass differential would have stopped the other vehicle cold and driven it backwards, which almost certainly meant instant death.

At first I wanted to grant the driver some grace, as the road just before the hill was a passing zone. Perhaps they under-estimated the distance needed to overtake, or worse, the guy getting passed got triggered and sped up.

But the passed vehicle was a truck pulling an RV, with limited acceleration available. And the passing vehicle was still way behind the truck as it crested the hill. They must hove foolishly started to overtake at the top of the hill.
Grace???
Despite my previous sarcasm, anyone passing in that situation should be charged with a serious Felony. Death of all involved was as Elon would say, "one of the possible outcomes" . Felony Reckless Endangerment at a minimum!

Other driver (non-CT) is 100% at reckless fault. The video evidence that can be captured will hopefully bring more at-fault drivers to justice in the future.

...all because they weren't patient enough to wait for the passing lane

That's not how it works. If every bad driving decision was a felony, our prison system would look like Escape From New York.

AFAIK, they typically reserve felony charges for serious bodily injury or death (particularly when combined with other offenses, like DUI, driving while suspended, or hit-and-run).

I'm sure the bad driver will be cited, and possibly lose their license, but I'm skeptical there will be criminal charges.

People are @$$ drivers anymore and in a hurry to get nowhere!

Ok, then maybe a Federal law needs to be passed for people to have driver tests every two years to keep their license and insurance.

Yeah I noticed that too, that probably helped differ a majority of the impact and if anything helped to deflect both cars away from the middle of the truck

Not his Cybertruck but he has a copy of the CT Camera footage 🤔 :unsure: .
WIth a Tesla "involved" it has to be making national news.

I'm sure it's been said already, but hire a damn lawyer. To be on that side of the road on a hill like that, I'd be utilizing everything within the courts as I could. Hopefully other charges will follow.
Also, remember your neck and back hurts. Do not mow your own lawn for some time.....

People are suing tesla for everything and anything.

They settled a case today right before trial where an 18 year old drove his tesla at 116mph around a 25mph curve, crashing and killing himself and a passenger.

Plaintiff is suing the 18 year old's estate and tesla arguing a tesla tech had disabled the speed limiter which would have kept the car at under 85mph. Tesla lawyers said speed limiter would have made no difference and that the driver was at fault for driving recklessly. Still, they gave in and paid to be removed from the lawsuit.
I'm reminded of two different stores

Publix, grocery store in the Southeast, they settle on all lawsuits.

Walmart, notorious for fighting all legal battles.

You can guess which company gets more lawsuits filed against them. Tesla needs to challenge every and all lawsuits. It will keep infomercial-lawyers from filing a lawsuit that they might have to pay out of pocket for.
