I understand your issue but legally they supplied you with an estimated delivery date that is subject to change.
There is still an opportunity to work in arbitration to explain and let them give the final word if Tesla is not willing to based on their current knowledge. I decided not to opt out of arbitration because going down the 'legal' route is pure insanity.

There is a lot of play here, and with arbitration it doesn't exactly come down to what's legal or not. It's the arbitrator's position to listen to the story and decide themselves based on the circumstances. It doesn't matter what the keyboard warrior's interpretations of what's "legal"

The $1,000 is an early access fee, I don think that by now anyone is getting “early access” I can by a CyberBeast from a dealer 3 miles away for less than $120k plus the majority of the ”extras” aren’t available yet so I would gladly sign the petition although I wouldn’t want a refund, happy to have the $1k transferred to a non FS or other model.

None of what you just said is correct.
The battery is not part of your purchase of the CB. It was never promised at any specific date what you’re doing is a pre-order for the battery and you’ll get it if they ever produce it whenever that is.

As you already told by another user above your delivery date was an estimate and it was always styled as an estimate the thinking that you should’ve been doing when you put down your thousand dollars was what happens if they try to give it to me early because had you read you would’ve known what the consequences of you not taking delivery in the event that their production exceeded their expectations at the time you entered into the contract to buy the truck.

So again, none of the legally significant facts are consistent with your recitation. Carry-on.

Incorrect. The $1000 was a nonrefundable earnest money deposit signifying the users intent to purchase a car when Tesla tendered it.

The $100 was a reservation fee which if you want to call THAT early access, go for it.

Incorrect it’s an early access fee. Thanks for the permission to go for it, that’s what Tesla refers to it as, maybe you should check your paperwork.

You said the it was breach of contract. It’s wasn’t.
The fact that you didn’t understand what an estimated date of delivery was or that it can change is on you and your lack of reading comprehension. The fact that you cannot acknowledge that and are now just arguing for what appears to be no reason is sad.

Again incorrect. You can literally Google what arbitration is so I’m not gonna bother to do that for you. You will be bound by the applicable laws you’re just not going to be clogging up the district with your nonsense. You may settle and the parties are able to work out any settlement arrangement that they want whether they’re in district court or in arbitration.

You’re living in a nation of laws. It would behoove you to educate yourself so you can do better.

Well then I suppose that you shouldn’t have any problem convincing a lawyer that he should go and demand your money back. Because even if this at best semantic quibble had any salience, that thousand dollar earnest money deposit ain’t coming back if Tesla doesn’t voluntarily choose to ignore their contractual protections.

When you “win” your arbitration “which isn’t based on any law” in Narnia please report back here on the results.

When you learn that contracts have “choice of law provisions” which dictate the law that will govern your arbitration come back with humility and celebrate your growth.

I suspect that since you’re just somebody talking (LOUDLY) out of the side of their neck that you’ll do neither but good luck either way. You’re definitely gonna need it.
