If it's in the shop that's considered towards the 30 days. Until they say it's fixed it's going to stay in the shop. You might want it to be different for some weird Tesla fan boy reason but that doesn't change the law.

I'm completely fine letting the arbitrator decide that and if they say Tesla owes me nothing so be it.

Better question is why they don't they just give me a different truck or at least give me a working Cybertruck loaner? Both of those would lessen the pain of paying $110k for a FS cybertruck that is not in my possession but they got my money + I pay hefty insurance on it.

Exactly my point, substantially lowers the value of the vehicle lol.

Give me $250k for a truck with defective 240v outlet and it's a deal.

Gets Tesla off the hook too since didn't impair value at all so all the fan boys win!

Literally no judge is going to look at your case and say "oh, you know what, that does count as presenting the vehicle to them for repair since you drove it to their parking lot"
In my observation of judges, he's more likely to say, "Wait a minute. Are you telling me your, now what do you call it, your CyberTruck? Are you saying this Cybertruck comes standard with an electrical outlet? A dryer plug in the bed? And when you plug something into it, it only works sometimes?" (followed by a stare and a look of disbelief)

After further analysis, this is quite interesting in the same section:
(2b) the same nonconformity has been subject to diagnosis or repair four or more times, at least one of which is during the period of coverage of the applicable manufacturer's written warranty, and the nonconformity continues to exist;

Combined with

(2c)A new motor vehicle is deemed to have been "subject to diagnose or repair" when a consumer presents the new motor vehicle for warranty service at a service and repair facility authorized, designated, or maintained by a manufacturer to provide warranty services or a facility to which the manufacturer or an authorized facility has directed the consumer to obtain warranty service. A new motor vehicle has not been "subject to diagnose or repair" if the consumer refuses to allow the facility to attempt or complete a recommended warranty repair, or demands return of the vehicle to the consumer before an attempt to diagnose or repair can be completed.

-> so if you go to the dealer 4x and they turn you away 4x because no appointment available that's enough to trigger the lemon.

That would only take 4 days / 4 visits instead of need to wait 30 days. Seems like we might be getting much faster service in the future if this prevails.
Yeah, I saw the same thing:
Not picking it up might work against claiming under clause b)

However, taking the car back because they are too busy to check it out may cause that visit to not count toward the 4:
" new motor vehicle has not been "subject to diagnose or repair" if the consumer refuses to allow the facility to attempt or complete a recommended warranty repair, or demands return of the vehicle to the consumer before an attempt to diagnose or repair can be completed."

Again making your customer wait on a brand new car for 30 freaking days is bad enough - normal company would be like sorry your brand NEW car isn't working so here's a swap.
If you do 'get your money back I strongly urge you to NOT buy another Tesla. You are obviously not able to deal with how that company operates.

Still kind of confused... The 71% part... are you saying the CAR you WANT to charge has to be below 71% or it won't charge at all? OR that the CT has to be below 71% for you to charge up some other car?

Second, if it's the first (car needs to be below), and the car is at, say, 65%, can you charge up to 90% or more or is it going to stop at 71% (or something else)?

They may not be able to. Many times the automaker might offer a bit more than required by law, and also ban you as part of a settlement. Or they could ban you post buyback saying this person is unreasonable.

There is no requirement to sell a product to a customer. Obviously one can't use certain reasons....in this case they don't apply.

A person I knew had a settlement that forbid to buy from said dealership, and car maker.

Forget the 2nd Tesla, no power can be applied on outlet when the Truck has more than 75% charge.

Cybertruck <71% = works
Cybertruck >75% = no work

Doesn't matter if it's a heater or a car charger or whatever. Mostly I want to use it as a welder but to test the outlet they're going to blame the welder so I demo with the car charger.

Even <71% I noticed draw > 2kW seems to reset it but car charger is pulling 7kW and charging the Y so that needs further investigation eg seems like the ramp up matters as welder is rapid 0-4kW but the charger goes up 0->1a->2a->...32amp

I was able to set the welder at 20% power and 71% Cybertruck battery it works but it is charged back up to 75% or 80% stops working altogether.

Speaking of which, I got truck back and driving around but Tesla told me next appointment Nov 7 which is pretty bs... They have 7 demo CTs in the lot for Cybercab party and build hundreds of cars a day and I need to wait for 30 days to get a new outlet harness? eg they can't pull it off a demo CT to test?

Bet still not fixed after they get the parts but at least I got FSD but still no way to work the welder...

You just need to read the settlement. The law states they need to buy it back. Doesn't say you need to abide by any terms. If they put in you're banned terms just don't sign it and let the arbitrator dictate the binding decision on them.

Sure they can ban you and cancel your order but I'm sure your wife can buy it or your brother or your friend or a car dealer if you really want it. No way they can refuse you service unless they just shutdown production altogether if they didn't force you to sign something since it's transferable. I suppose they could put a restraining order on you if they convince a judge to sign it but that's pretty tall bar.

If all you want is something that works like you paid for it, you shouldn't be afraid to ask for it unless you are a pansy.

It seems really silly to me you want a lemon law your cyber truck over a 240 volt plug you might use a few times a year and your truck be charged over 80% to use it .. Should it be fixed ? ABSOLUTLY. Do you have a huge gripe it sat in the shop to long ? 100% but it isn’t like it’s causing you a driving issue or broken down. It’s an outlet . Seems like you should have pounded the phone and the manager at the service center more. Squeaky wheel gets the grease my friend ! And your answer is when your going to use the welder don’t charge over 75% ?
but btw what kind of welder you going to try to run on it ?

Since it works when your batterry is below 71% I am gonna blame software or some obscure current sensing part. Hope they get it fixed for your sake.

I had my Tesla charge to 100% and use the 220 outlet to run my house for five hours during the hurricane and didn't have any issues

you're going to be incredibly tough pressed to find a judge/arbiter who agrees with your pretty wild assertions.

Specifically: "I took it to the dealer, and they turned me away because they don't have an immediate service appointment available, so that counts as an attempt to repair and also starts the 30 day timer"

You keep posting the same bits of the law over and over, but none of it has any meaning beyond your assertion that you feel you have started the timer or had it counted as an "attempt" since there was no available appointment on some random day when you happened to show up there.

Everyone has to wait in line for service. if the law worked the way you are pretending, no manufacturer could ever sell any car. They can't give everyone immediate service or a new vehicle because they don't have people standing around waiting to bring cars in and fix them that day every time. The service line would remain just as long, and the car prices would triple since everything would just have to be perfect when it leaves the factory, tested for 3 months and 10,000 miles. Every button, receptacle, latch, tested to a thousand cycles. Every "new" car would really be used, because they would have to test it very extensively to prevent any car from ever needing service. Since every manufacturer has issues getting parts quickly and scheduling service appointments, this would just be a catastrophe for the entire auto industry. It's just not possible.


Sorry that you're having trouble with your truck, but you aren't special for any of the reasons you seem to think that you are.
