From the video, it looks like she's holding the phone in her right hand. Initially it's just below the top of the steering wheel, but she raises it up right before impact and it looks as though it drops onto the dashboard and then flies away.

I didn't see the one on the left, hands down she has the phone in her hand. The one on the right it's harder to tell, at least to me. Either way, she doesn't have a defense because she didn't even slow down, before impact.

You can see the cell phone in her hand in this pic!

This is my number one case for autonomous driving. How long until FSD is as good as the world’s best driver? Could be never.

But it’s already better than a lot of people, and those tend to be the ones that cause accidents.
The drivers in my town are definitely getting worse.

Tesla can make the truck safer, do some updates to get people’s attention while braking.

Pulsing lights etc.

Did some good light examples in the Christmas update…top video is far better than basic below.

Exactly!

And I never showed her any emotion btw. I was upset because my brand new car was just crashed into but I was very composed when I walked over to her. Remember that at that moment I hadn't reviewed the video yet. I had no idea of what had just happened. I was standing there just waiting for an explanation from her but it got pretty awkward so I just asked her if it was ok for me to take photos of our cars.

She was either in shock, under the influence, suffering from a concussion, or very socially awkward. She stood like a statue and just stared at me. She didn't ask me anything or say anything to me. It was a very strange and awkward few moments before the police arrived. That made me even more upset. She could have at least apologized for the accident but instead she decided to remain silent.
At this point, it's probably best for her that she didn't say anything. Otherwise, her attorney would have been ripping her a new one for any kind of admission. (My attorneys have said not to say anything that could be an admission.)
Is hands-free required and distracted driving a violation where you were? Did she get cited yet? Good luck with a suit. Best of luck with repairs.

Rear-ending a car with 7 cameras and then thinking "let me not apologizes because I'll look less guilty that way..."

In the end it doesn't matter, legally, if she apologized to me or not because it's always going to be "he said, she said." It's what she tells the police that's really relevant to her hypothetical lawyer.

I don't know what police did with her to be honest. They absolutely should cite her. Yes, holding your phone while driving is unlawful in NJ.

As a life-long photographer, I can tell you that you do not ever need anyone's permission to take pictures in public (and especially not of the vehicle that just ran into you). If you are allowed to stand there, you can take pictures. This is the way it's always been in the U.S. The right to document public life extends far further than the new woke and entitled mindset believes. No, you don't need a model release to record someone else's likeness, even if you want to publish the photos online. Adults and children are no different. None of them have a right to privacy when they are in public view.
