To be clear, an over-loaded vehicle is definitely a liability. But prosecution of over-loaded personal vehicles is not done in a majority of cases. What people don't realize is the simple fact that the vehicle is over the rated limits does not provide an airtight case for a prosecutor, they have to prove beyond a reasonable doubt that the damage was caused by the over-loaded condition.
I'm not sure those people exist on this thread.

Rereading, I think people are parsing the post differently:
"Until you get in a wreck, and the load is exceeded the vehicle rating and you’re at fault."

I think people are arguing against "and you're at fault" as if it is saying they were found to be at fault due to being overloaded
Versus
The driver was at fault, and the vehicle was overloaded

I read:
"Every time, that vehicle operator was at fault"
as the operator was at fault regardless of the weight.

IMO, overloaded vehicle is more of a risk than a liability. Why do you not jump the traffic or drive at 45 mph in neighborhoods? Is it because you are afraid of Jail time or you worry about safety, or both? If a kid suddenly jumps out of nowhere in a neighborhood, you cannot stop in a reasonably good distance if you are driving at 45 mph. We can sit and debate all day long on all the awesome brake performance of the car, but it’s more of a safety concern than a legal ramification. Physics won’t allow you to stop the vehicle quick enough when you are overloaded, but if you are hauling things in a neighborhood at 10 mph or within your property, it’s a different story. Common sense is more important than OEM specs. Ask this guy if he went to jail. Apparently he did not, but doesn’t mean it’s Ok to drive this way risking everyone’s life ?‍♂

That is good testing exercise to see how weight impacts the energy consumption. Being 4000lb bricks under the touneau cover, there was no aerodynamic change, so the only factor was the weight which cause the consumption from normal 375 wh per mile to 495 wh per mil

So we can calculate that every 1000lb weight increase, it only needs additional 30 wh per mile unless the aerodynamic changed.

So for 4000lb trailer with same aerodynamic 6000lb trailer, eg. airstream bambi 20' vs flying cloud 25',the difference is only 60 wh per mile. I tested for bambi 20, the average energy consumption was 675 wh per mile, it translates the max 182 miles, we can estimate for 25' flying cloud, the energy consumption would be 735 wh per mile, it translates 167 mile, there are only 15 miles apart the both trailer. It proves again the aerodynamic is much more important than the weight itself.

Want to watch a show? Watch an overloaded garden trailer break its axel in the middle of an Interstate.
Of for that matter am overloaded pickup truck.

Who is at fault then?
It's almost always the driver's fault. The secret is to not cause your truck to fail.

I can load either of my trucks to the GVWR (and no more) and break both of them simply by doing dumb stuff.

I have overloaded trucks my entire life since I was 16 years old, the secret is to not break them. The GVWR is not the be-all-end-all, it's just another data point.
