New meaning to "Fender Bender"

Some chic in a Nissan Altima smashed into me while I was not moving.
I stopped up a head of her just slightly in her path as I was looking to go left
But saw her coming from the left. I decided to let her pass first. Except she never saw me because she wasn't paying attention.
And instead of slowing down and changing direction she accelerated and turned into me.
Afterward claiming that even though she wasn't paying attention she had the right of way
And even though I was not moving and she hit me that it's my fault because she had the right of way.
Right of way is what I was giving her when I stopped and gave her the right of way. Somehow, she took my near right of way violation
and turned it into the right to crash and not be at fault.
also noteworthy is most of the damage was to her car
But she seemed amused by the whole thing.
What do you guys think who's fault?

take a good look at the damage on my front bumper. A piece of her headlight got logged into my bumper at the point of impact. It shows the direction of movement and direction of impact together with where the cars ended up and their position one can accurately conclude that the Altima hit my nose as I was standing still that's the only way the head light leaves a piece logged on the driver's side of the bumper and slides through my license plate and end at the other side of the bumper unless cybertruck can now do craw drive and I was not aware that it was moving sideways.

In NY you are supposed to be in full control of your vehicle at all times. So if you wanna get her insurance companies attention claim you are going to the hospital because your neck hurts.

No one has 'right of way' over a stopped vehicle. Number one rule of driving is: Don't hit stationary things in your path, whether they're supposed to be there or not!

Wait so you were stopped in her lane waiting to make a left? You shouldn't be obstructing traffic, it's definitely illegal. That said she shouldn't have hit you.

FAFO on playing chicken seeing how far into moving traffic you can go without getting hit.

Show the video so we can see if you were in the lane, because the second pic makes it look like you're halfway in the road.

I had a collision similar, although I was in my lane. I was going down a two-lane, straight urban street and this Cadillac turned left and cut across my lane. I came to a full stop and honked and was about to reverse when he hit me.

Claimed I didn't have my lights on. I replied that I always drove with my lights on, day and night. Officer looked at my lights (completely smashed) and said, 'well, they're off now.' Though insurance believed me and paid out for my poor Civic.

I don't know if there is a video. My tesla insurance claims adjuster said that they have access to everything from their data base they just need my permission to access it and use it to determine who was at fault. And of course, I said yes permission granted. He told me it takes about a week for them to analyze the footage and put together a video that they will then send me and the other insurance company a copy of the video. Until then I don't have footage that I was able to find myself on the memory stick I found nothing. Which I find very disturbing because I used the horn immediately after she hit to make sure it records and saves. I also made sure that this feature is turned on and it was. Yet I found nothing except for only from before and after the crash.

and it looks like im half way in the road because there is a row of parked cars against the curb and my nose is just beyond the cars but there is more than 3 car widths of open road out in front of me. So, no I was nowhere near the halfway point this street is at least 5 cars wide side by side and I was at 1.2

For anyone I’d recommend that you familiarize yourself with the recording, how to extract it, what the limits are before something like this happens.

been many of times when I hit the horn to capture footage and when I play it back all to realized that part of the video is not there. Like you have to wait 45 seconds or so then honk and scroll back on the video before the red event indicator.

Sorry this happend. Hopefully Tesla will get the insurance footage squared away.
