Sales tax on orders incorrect? (CO residents READ!)

Do we have any insight into whether they (Tesla) will accept a transfer of the CO Innovative Truck Credit at the time of purchase now that there is no MSRP limitation (based on my interpretation of the latest guidance document)?

yep… no MSRP limitation. $5K in da house! No idea whether Tesla will give it or not at point of sale…. That’s above my pay grade and likely a question directly to Tesla. Either way you get it… at worst case you fill out a form and it comes off your taxes at tax time. But I’m with you… I would rather write a lower check and make that sales tax more or less disappear all together when I pick it up.

I just saw 1.0% on a google search. So I would still pay 4.13% if I picked it up in either place? Wonder what it would be if I picked it up in Austin (don’t even know if I can do that)?
ok I found out for an Austin pickup. Texas does not collect sales tax if you directly take it back to Colorado:

However, you will pay Colorado state use tax (2.9%) and your county/city use tax. Therefore getting it in Texas will bring you no advantage over Littleton as it would be the same.

Order has been placed (Dec 21, 2023), and awaiting VIN assignment. Also live in Douglas county, and tried to take delivery in Austin but was told by the Littleton office that I could not. Sounds like I need to re-visit that. They had told me that delivery would be in Aurora, but it would appear I could insist on Littleton. Thanks for your help on this

I called up Tesla to change delivery location. They said I can’t change because it is auto-assigned. She also said Littleton is not a pickup place anymore ?‍♂ I probably try to call back tomorrow and get someone else.

Alright, second yielded more info:
- she said the taxes are based on your address on file
- Littleton is not a pickup spot (Colorado Springs, Loveland, and Gypsum are pickup locations)

Alright, second yielded more info:

She is wrong... check the links I provided above. Its Colorado State law... they have to charge you what the State says they can.

I spoke to Tesla and they said "Oh well you are 4.4% because you are La Plata county"... I said "no... that violates state law because I'm picking it up in Gypsum. Unless you are delivering to my house, you are attempting to collect tax that isn't allowed."

I would escalate that... they can't charge you county/city tax if you pick it up somewhere else. Send them the documents from the links. They should know better. I bought my F350 last October from Phil Long Ford in Jeffco and they only charged me 2.9% sales tax.

Look at Gypsum/Eagle County as I know its 0% on Use Tax. You can look into Loveland/Larimer in the document provided before and see if there is use tax. But I do know Gypsum will be 0%.

I just exchanged messages with Tesla. Good news... I was correct:

Me:
Hi.... my order is RN11285xxxx (Cyberbeast). You have sales tax listed as $7,823,04. That is showing 6.4%. I live in La Plata county, Colorado. I am picking up in Gypsum, CO. Under Colorado state law, I can only be charged state tax (2.9%) plus use tax of La Plata County (0%) and use tax from Gypsum/Eagle county (both 0%). So my sales tax has to be 2.9%. Why are you showing 6.4%?

Hi There,
The tax was automatically calculated based on your ZIP to generate an estimated tax. We will adjust your taxation to 2.9% to reflect your exact address. Typically our local teams finalize these amounts when a VIN is attached to a Reservation and that Reservation is assigned to the local Delivery Center ahead of your Delivery Date.

We will be able to modify the Final Taxation amount when a VIN has been assigned to your RN. But 2.9% is the correct amount.

Got my VIN, but I'm currently looking at 9% Sales Tax? I'm in Boulder. Loveland is 50 mins, so my best bet is probably to pick up from there? Willing to drive wherever if I'm saving thousands of $ on tax ?

Call your advisor… they will change it. I picked up mine today and it was 2.9%

My pickup location is loveland, if it ever happens. I believe that's on the lower end of the %, but will have to check.

Just spoke to my advisor in Aurora who is absolutely insistent that I need to pay the 9% sales tax. He said they do this 'dozens of times per day', that I am misinformed, and that there's absolutely no way for them to change the sales tax amount without updating my address to somewhere else. I asked to speak to someone else and he said there's no one else to speak to. They said they use this website to calculate tax: https://colorado.ttr.services

He said my VIN is locked to the Aurora location as it's already there and if I want to switch to somewhere else then I'd need to release the VIN and wait for another truck to arrive at the alternative location.

Extremely frustrated at this point. Wondering how to proceed. Delivery is supposed to be Friday but not willing to pay an extra $6k in unnecessary sales tax. One option is to pay the tax up front, then try to get it back later? Probably a huge hassle.

OK, so now that I used the tool they do... it's actually listing the 'Use Tax' as 9.045%. Guess there's no way around it ?
