Cybertruck for sale through exotic car broker

Hey everyone I know this is a hot button subject but I thought I’d post since it could end up benefiting one of us with deeper pockets.

A client of mine is an exotic car broker and we got to talking Tesla and he said he will have a Foundation Series Dual Motor soon for sale. I would expect a pretty big markup since this guy deals mostly with car collectors from around world. So there’s a good chance this ends up in someone’s car locker or flys out overseas. Or it could end up in your garage haha.

I asked him about the no resale clause and he said that’s really more to keep folks from selling them on public auction sites than anything else and that they have legitimate ways of getting around the paperwork so both parties are protected. He said he sold 3 of the last Ferraris and a couple other cars that had the same sort of clause.

The no-resale clause is done to prevent the majority of the people from taking a delivery or not even delivering and just selling their allocation to the scalper that is waiting outside the delivery center and is paying 10-20k CASH over what you paid to you for instant profit so that they can mark up another 30k on top. I can guarantee you more than half of those 2m pre-orders will convert if there is profit to be made!

These private sales involve a lot more paperwork and they can't just get some random dude who got an allocation to sell them a truck.

I’m not here to debate the morality of this.

Scalping is a move for scumbags, no matter how anyone tries to spin it. And there have been plenty of people already coming to the forum with their sales pitch for selling RNs...

However, using a full on exotic car broker to get their hands on one of these trucks is arguably a different matter and I'd be curious to see other people's reaction.

My personal take is that hiring a broker is one of the perks of being significantly wealthy; and unless it's done en-mass, it seems like a drop in the bucket compared to typical retail sales.

Any car before 2010, I don't see how a no resale clause would be easily enforced.

For cars made now, they are essentially computers on wheels. Would it be legal for Tesla to brick the CT if it was flipped against the terms of the buyer's contract? Could they no longer offer software updates, as a less extreme response? I suppose if the private sales agreement notes the Tesla User ID is being sold as well, so Tesla can't see the transaction, that may be a way around this.

Again I don’t really know much about it, but I do know he is doing well based on the 3 garages we have done security and surveillance for haha. But yeah he mentioned it all depends on the way it is written. So they have done like a trust with a holdings, created an LLC that both parties join and done a lease with an up front lump sum and a small exchange after the terms have been exceeded. Interesting stuff. I’d like to see how it shakes out. I’ll report back if I talk to him again and see what they did.
