You need to write them. Use certified mail, I think FAX is also considered legally "in writing". If they do not respond you should be able to sell without issue. I am unsure what constitutes "reasonable time", but it would be easy to argue you followed the process and didnt get a response.

Having to make 1 or 2 more payments would seem unreasonable to me. Most auto dealerships can inspect and purchase your vehicle in the same day, so I would even consider 2 weeks unreasonable.

I am unsure of they way they wrote this gives them unlimited time to respond to you or it has a "reasonable time" expiration.

Definitely contact a local lawyer as contract law is a state issue. I can't imagine that a manufacturer can stick you in an untenable situation where you go broke or ruin your finances after an unforseen event.

I take the contract to mean they will either buy you out with a sizeable discount or allow you to sell on the open market. Can't imagine a court would say they can refuse both but maybe...

I am certain that a letter from a lawyer will move your claim up the food chain to someone with authority to weigh the risks and benefits of holding their position. My local SC told me they make the choice, not corporate but take that with a bag of salt.

The trend I *think* I'm seeing is a lot of folks that have never had a Tesla bought the truck and are completely infatuated with it. Folks that have owned multiple Teslas for many years are disappointed in what it *could* have been. Meaning their expectations were very high. Or maybe it was just me. At the end of the day, I'm still very torn on keeping this truck. I do like it a lot. It still seems like it might be the best EV truck available. I still find it a disappointment over what I think it could have been.

I sure did. And it reads like a first right of refusal. Meaning one gets their lawyer to draft up paperwork stating that Tesla has X amount of "reasonable" time to purchase the vehicle back from them, minus a rate of $.25/mile plus any repairs. Include a "silence is consent" clause. Wait until Tesla Corporate does nothing (what they do best). Sell truck private party. It's not rocket surgery nor brain science.

I have owned Teslas since 2019 and I love my Cybertruck.

Howdy partner. Why didn't you climb down off that high horse? Contracts absolutely matter to me. Quite an unreasonable jump to accuse a person of not abiding by laws because they are using a reasonable tool from a clause in a contract. I've reported your post for ad hominem attacks.

To further defend my personal character on a mostly anonymous forum from some stranger I've never met... I choose to live in a society of personal freedoms wherein a person can not be forced by a $500B company to keep a product they purchased without ever having an opportunity to test out, and before many real product reviews are available. I further choose to live in a country where civil contracts are not "laws," and typically have reasonable remedies for disagreements, wherein one could have the freedom to not be stuck with a product they dislike (for any reason). You seem to be conflating civil contracts with laws. They are two very different things.

To the OP: The order agreement clearly outlines how to sell your truck back to Tesla if you no longer want it. I think most lawyers would agree that it is a first right of refusal and Tesla has no grounds to force you to keep their product. But, you should spend the money on a lawyer, rather than taking some "law breaker's" advice off the Internet.

Yeah, they (we) like the truck. It’s under warranty so we don’t really care. Everyone is free to buy a vehicle they want. We chose the Cybertruck.

Tesla offered me a buy back as stated in the contract, but I will lose like $15k in taxes so I didn’t sell it back. They said they will sue me if I resell it to others.

Interesting. You’re the first I’ve heard actually got a buy back offer. And yes, makes sense your loose the taxes. Sucks, but makes sense.

And also that they are continuing to enforce the resale clause. That indicates we may see a wave of people that resold/ flipped the truck getting letters for breach of contract soon. I know that “how enforceable” that portion of the contract has been beaten to death here. But we might just see Tesla try it in the courts.

Just my musings and guesses.

I got a hold of them by texting back on the CT text message chain. Then they followed up via email.

I rejected their offer and said I will sell to 3rd party if they can’t match their offer.

I heard this weekend that Tesla will not be going after people that sell the CyberTruck. It was someone from tesla but I don't remember their title.

Owned the entire lineup of Teslas since 2019, currently have S Plaid and AWD CT. Absolutely love this truck. It's been 5 years and it was my first Tesla reservation order and I'm finally enjoying it.

Meanwhile, saw my 3rd F150 Lightning being towed back to the dealership today, where's the headlines? Oh, I'll start "Ford F150 Lightnings all failing having to be towed back to the dealership because some shmuck on the 'net saw 3 so it must be all of them".
That should be a huge headline being that Alabama has sold all of four F-150 Lightnings in the whole state.
"75% of Electric Ford Lightning pickups in AL have failed battery packs!"
