As the relationship between artificial intelligence (AI) and copyright continues to develop in the legal sphere, a group of visual artists have scored a small victory in court. On 12 August, US District Judge William Orrick ruled that the companies Stability AI, Midjourney, DeviantArt and Runway AI were violating artists' rights by illegally storing their works in their image generation systems.

Thanks, while they are not "the same" they are most definitely similar, and likely AI generated. So maybe this will be an interesting case to follow? I'm far from an expert and appreciate there may be a fine line between copyright/fair use and "in the style of......"

This was a presentation about Tesla products.
A specific mention of Blade Runner and use of any images similar to it were not needed at all.

Elon knew he didn't have permission but he is rich so he feels he can do what ever he wants.
What is the rights owner going to do. Sue him. Elon doesn't care. Like a honey badger.
To us regular people and relative to his wealth, a million loss, Elon could lose more more money falling out of his pocket while gaming on his computer.

It's an ongoing discussion on legality that's affecting alot of AI generators. It seems to be falling on the side of original creators, and they need to be asked and grant permission.

In this case it's kinda egregious because Tesla got told no, but seemingly did it anyway.

He asked, they said no, he used something different. If he was rich and didn’t care, he would just have used the blade runner picture.

Here we go, lol! I KNEW Elon wanted to challenge Ai generated content in court. I bet the other studios will bring a very large hammer down on whoever owns Blade Runner. They do NOT want to open that can of worms lmao

Why / How could the "other studios" bring down a large hammer?
Because there have been cases in the past where the subject of Ai generated content has been on the docket and the matters were resolved privately without going forward.

Long story short, all the major studios would open MASSIVE floodgates for lawsuits against them for "prior art" and "derivative work". Most studios are absolute scumbag money grubbers who hoodwink artists into signing away their masterpieces. The icing on the cake is when people find out that these same studios live on both sides of the law (very much like social media companies "publisher vs platform" argument)

Elon knows this and wants them to either put up or shut up. Because no-one should be able to copyright "man in trenchcoat staring into the distant city ruin". But then again, Apple was granted the rights to patent a square, so here we are. A complete and utter mess.

yeah, but does their copyright give exclusive rights to the "futuristic dystopian society" theme? If so, I can't wait to see studios suing other studios. This is going to be fun.

The issue is whether tesla in this case used copyrighted materials to train AI to generate something "similar".

For the Alcon to go out guns blazing means they know got some info into what tesla did.

It's ironic because teslas people knows as much what this is. Tesla's people also do what it takes to get musk what he wants.

It's not an image from the movie, nor is it substantially similar. The case probably won't get very far.

Where tesla and musk fucked up is that they explicitly asked Alcon to use it for cobranding/licensing.

You can't claim ignorance on "oh it's just a generic apocalyptic similarity" if you got told no.

I don't know how else to express this: Elon Musk is definitely aware of the impending copyright storm surrounding Ai generated content; he's talked about it quite a bit.

Trouble is, we will need to turn the entire human works world upside down if we determine that Ai cannot use prior works as inspiration for generating new content.

That would mean virtually every single human artistic expression is now open for lawsuit, since absolutely zero person on this earth can, with a straight face, say that they used zero inspiration for their creative work.
