I did criminal law for decades. The worst behavior from clients in court was generally traffic court. Hitting a pedestrian is not a rule of the road. Pedestrians are human beings to which a duty of care is owed. There are laws which establish criminal guidelines for minimum practices to ensure their safety. At no point do these minimum standards forgive intentionally, or in most instances recklessly or even sometimes negligently, harming or attempting to harm another human. Negligence is often a matter for civil courts, but a duty of care is ALWAYS still owed. Intentionally damaging property of another is still a crime, but in this instance no actual damage was done. Actual damage is an element of criminal mischief. The only thing (thank goodness) injured here were feelings. Dismissed. Next case.
