I would say that cars ALWAYS have the right of way. It is much easier for a pedestrian to stop before walking into a car than it is for a car to stop before running into a pedestrian walking onto the road. That's like saying cars should have right of way over a train.

too much authority and you never know, might have to cross anyway

better with the obvious, someone not even watching

I did criminal law for decades. The worst behavior from clients in court was generally traffic court. Hitting a pedestrian is not a rule of the road. Pedestrians are human beings to which a duty of care is owed. There are laws which establish criminal guidelines for minimum practices to ensure their safety. At no point do these minimum standards forgive intentionally, or in most instances recklessly or even sometimes negligently, harming or attempting to harm another human. Negligence is often a matter for civil courts, but a duty of care is ALWAYS still owed. Intentionally damaging property of another is still a crime, but in this instance no actual damage was done. Actual damage is an element of criminal mischief. The only thing (thank goodness) injured here were feelings. Dismissed. Next case. As always, for those advocating doing something stupid, the legal community thanks you in advance for your patronage.
This whole discussion reminds me of the following. My wife, who previously lived in Juneau, AK (very small town), and I were in San Francisco in the early 70's. I don't remember it all exactly, but I do remember her walking out into traffic. When I grabbed her and pulled her back to the sidewalk she complained "But I had the right of way" to which I responded "I'll put that on your grave stone".
My $.02? Making a point is rarely worth the expense. Sure, it might make you feel good. At least right up until the dire consequence kicks in.

You blocked him. He didn't walk out to kick you, you drove up and blocked his path.

No, a pedestrian in the road always has the right of way. Anything already in the road, for the most part, already has the right.

Even if they're violating the lights, they still have right of way over you. Sure, it's a ticket for them to run against the light and block traffic. But it is also a moving violation to enter a crosswalk with a person in it.

The pedestrian's wrong doesn't make the driver's right.

Dude you see him crossing the road, pedestrians always have right of way. You should have waited for him to cross regardless of his complete lack of attention to the traffic signals. Yes he’s completely spaced out, but be responsible and keep everyone out of harms way. Situations like this are best dealt with through patience and just letting it go. It’s not that difficult.
I'm quite sure FSD would have waited...if not, an intervention would have been the more polite choice. Cars against pedestrians is never a fair match.

is this recording a standard settkng? I have not seen on my ct any recording while I was driving.
You see all these comments on here and none will address the serious questions about important things that we can learn from, and this post has brought to light. like how exactly he captured this video while some of us don't have any videos when actually driving. and some don't understand how a certain event was not captured or even recognized as a near collision.

I remember J walking once when I got a ticket.
but I was in junior high. walking home from school man and this was a small street no cars coming and I ran across. and I don't know where this motorcycle cop came from, but I was already like halfway down the block when he comes in hot on his bike jumps the curb and blocks me from walking with is motorcycle like I was a chase suspect or something I was like what the hell. he tells me don't move while he turns off his bike puts the kickstand down takes off his helmet then his gloves. I'm thinking what the hell did, I do? finally he tells me you J walked back there I was like I did? he says you sure did, now he wants my ID or license. I say I don't have a drivers license sur I'm 13. you have any ID I give him my school ID and he writes me a citation. they must have been hurting for money. but I saw the judge with my parents and got the ticket dropped we told him what the cop did and he dismissed it.

I'm unclear on how where I'm living today changes my ability to know and read the law in other places?

How many states have you taken the driving tests in? They're all slightly different!

Right of way is determined by rules, who's required to give way to who. At sea, it's tonnage, on the road, it's traffic laws. Pedestrians usually have the right of way in a crosswalk, the general exception being when they have a red signal. There's little question from the clip that the Cybertruck has the right of way. All that means is the pedestrian is required to give way for the Cybertruck. The moment there's an actual collision however, a whole different set of questions are going to be asked, both criminally and civilly. Accelerating from a stop and running over a pedestrian in the road isn't likely to go well for you in either situation.
