COMsci speak this is called a corner case. A test suite set of conditions that exhibit a flaw.
The flaw in this instance ā€˜conesā€™. Lots of cones, cones spaced and cones on both sides of what FSD would label its ā€œlaneā€ of travel. One variable- speed. One threat assessment - static toy.
Static toy in the test suite stands-in for human.
Hypothosis: FSD will violate Rule#1 ā€œcause no harmā€
Recap: FSD stays in its lane, travels to test suite stand-in and executes EBS striking static toy.
Analysis: FSD failed to implement safety systems within the required braking distance.
Summary: The test is purports to be one demonstration showing a Tesla starting a test ā€œin a safety cone laneā€ and driver engaging the FSD software lever. FSD is not shown to be active at the point of contact. The vehicle operates nominally braking late and braking not as hard as Tesla EBS striking a stand-in human test subject. One follow on segment shows the Tesla rolling-thru the stand-in human test subject from driver perspective for dramatic effect. This is in contradiction to the immediate preceding segment showing the Tesla braking. The video does not appear to substaniate what it purports that Tesla FSD is engaged and that FSD is under software control of the vehicle as it drives thru-a human test subject in its lane of travel. The Youtube clip appears to be a sequence of video segments constructed in a deliberate fashion to support a software operating thesis ā€does it work?ā€. In fact, nowhere during the test are conditions reported wrt:speed, software state, EBS status and driver action in order to assess, judge or overcome the dramatic closing image of a child going up over the windshield. Great demonstration piece if it all were substantiated, controlled and objective.

It's been noted by others that even when FSD in engaged, pressing the accelerator will override emergency braking. Was the driver holding his foot on the throttle?

They filed affidavits claiming they "followed the directions" for FSD, but then contradicted themselves by stating they drove without touching the wheel. They also say it "Failed 3 times" but did not say how many tries that took.

I rate this nonsense 3-star bullshit.

Also, FSD takes "safety cones" very seriously. While painted lines are treated as a suggestion (for the purposes of collision-avoidance), safety cones are considered to be impassible barriers since there could be workers, or extreme hazards.

This "test" was designed to cause a failure. Almost never would you find a one-lane "chute" flanked by impassible barriers, since this is highly dangerous:

This would also be a terrible, terrible place to play catch. While I agree that drivers (both organic and computerized) should make every effort to avoid hitting pedestrians, some blame rests with those illegally crossing the street.

Thatā€™s what I thought starting to critique the clip. With a degree in computer science and stint as Dir of Safety for the third largest irregular route carrier in USā€¦it looked achievable to breakdown the ā€testā€ being demonstrated.
Once into it the segments didnā€™t match-up, the sequencing was broken and at that point there wasnā€™t a test to analyze. It deteriorated into fiction, made for effect and in the eyes of one more legally knowledgable entirely different outcome than what the test purports.
Not a lawyer, not election speech trained nor a scientist able to testify that the test is reproducible three times.
Tesla should reproduce the exact same test by third party experts in performing safety tests. Go from thereā€¦ it just doesnā€™t look like the test is proving what is claimed. Itā€™s construction has cuts and segways to prove a narrative to support an entirely separate outcome.

Someone needs to put Dan's self driving software against Tesla FSD. Compete in 50 different cities in at least 20 states. Then we'll know which is better.
