Yes, that’s how capitalism works. They take on the risk of scalping. If they fail, they lose a lot of money too
Well in this case, they also will owe Tesla $50K.

Thank god there are 654,114 people in front of me. I don't have to worry. I am seeing a price cut by the time my number comes around.......hmm they probably won't cut prices until they go through all the reservation. Still. No worries here.
My analysis, without even knowing what the prices are at the initial release, is that Cybertruck is more likely to go up in price after the reservations with prices locked in are fulfilled, then it is to go down. Eventually, like in 4-6 years, the price might go down, but I think that time is quite a ways off.

Please remind me how I did on this call in three years.

Or challenge them in court to see if it holds. Similar sort of shenanigans happened with the whole right to repair when people buy products. Turns out it was illegal to prevent owners from fixing their products

Well, I reserved my CT on unveiling night, and I just looked in the "Documents" section on the Tesla website under my CT reservation, and my document there is still the one dated 11/21/2019 and it doesn't have this new language...
No, but when you reserved you agreed that the vehicle was for your use, not for resale.

So I buy one in cash with the full intent of keeping it, drive it for a month with the pink slip in hand, but decide I don’t like it.

Shouldn’t I have the right to sell it on Craigslist?

When I sign the damn check the vehicle is mine and ALL mine and I will do with it as I please. I can run it off a cliff which I have heard is a popular trend and Tesla can pack sand. When MY name is on the title and no one else's it's MINE, not sorta mine but ALL mine. Are they gonna come after me if I crash the truck in a jungle in Central America inside 12 months.
You are absolutely right. The CT is 100% yours and you can do whatever you wish with it whenever you choose.

So long as you don't sign a contract/agreement that says you agree to the following terms. Oh, the CT is still 100% yours and they can't stop you from selling it, so you win there. But the agreement outlines their remedy for you breaking your word. But they didn't stop you!

I need some help on a more pressing concern.

My wife loves to make tacos and she is healthy and all that so she makes them with chicken.

I'm believe it should be beef. Am I wrong?

PS: She uses an iPhone and I swear by Android. Thoughts?
Marriage is the ultimate give and take...

You are right on the tacos, she is right on the phone. And for the record, I really don't like Apple. But after having both, their stuff just works and I don't have to kludge it or find work arounds. Android OS is so close to my favorite Unix, but the open system causes compromises.

The only options for beef are steak (still beef), carnitas, venado, and bisonte. Yard bird should be limited to enchiladas suiza. Even loaded nachos should be beef!

Didn’t Cena already lose this battle in court?

ELI5. If it’s so great, I would never want to sell it.
I would sell mine for $2 million, if I had not already agreed it was for my own use, but that's not going to be a realistic expectation, so it's a big nothing-burger. My point is, everyone has a price. I can see a handiman who makes $70K/year wanting to sell it if he determined his profit would amount to a years pay. But Tesla would rather see it go to the handyman, and show up for jobs in peoples driveway than be parked in the estate of a billionaire who bought it to have the latest and greatest.

Those of us in line will be glad if people who reserved solely to make a profit decide they don't need to be the subject of a lawsuit, especially considering that all the facts will be on Tesla's side, and they will probably lose. About two years ago, Tesla started beefing up their legal team to take on bad actors.

I really see this clause as being broadly beneficial to everyone who agreed to the terms of the reservation. Even if someone buys it and then loses their job three months later and needs the money, it will be good for them. Say they drove it 3,000 miles in those three months. If it's in good condition, Tesla will buy it back for $750 less than they paid for it. That's really good in terms of depreciation for a new truck!

Capitalism works that way in the absence of a contract. But there is always a contract with the purchase of a new car and terms often differ.

It sounds like you are saying capitalism doesn't respect contracts. That has never been the case. Capitalism has been built on contracts for at least the last several hundred years. Contracts are the ruling documents in capitalism (right after codified laws). Your position pretends that contracts are not allowed. The law clearly allows and makes wide provision for contracts between consenting adults. If you don't like the terms of the contract, don't enter into it!

I'm conflicted.

I don't like the idea of needing permission from Tesla if something happens and I need to sell.

But I also don't want a bunch of scalpers taking up all the stock in the beginning.

Good thing it's not up to me. I just have to shut up and color so I can get my truck.

Well, it seems you might be a little premature with your judgement that it is illegal. The two cases outstanding Lambrix v Tesla and Orendian v. Tesla, don't appear to have judgements entered quite yet. So, as they say, the jury is quite literally, still out on that one.

Meh, pay no attention to the keyboard warriors like that dude, CB. Not worth your energy. Hopefully admins banned that fool.

That being said, I’m with Pete. Gotta go with the beef.
