Not sure why it can't be sold as 'new' (in tax credit sense) as long as it was never registered. For example, I bought a 2017 TMX late 2017 that was a Tesla service loaner and it was sold with a discount but still qualified for the $7500 tax credit since it was never registered. In San Jose California (Santana Row) there is an early Cybertruck in the showroom that’s wrapped in a cool dark green. It’s got about 85 miles on the odo and its VIN is in the mid 700’s. Eventually they will likely sell that truck as an inventory vehicle, for example. They can’t sell it new! There must be a bunch of similar examples all across the country that will be sold and replaced w fresh or new models.
