good for them, I don’t see Tesla doing anything. Either they go after everyone or no one, and as of today this is number 10 that has been flipped as far as I can deduce.

The brilliance of the way Tesla wrote the "no-resale" clause is that they specified the remedy should someone decide to ignore the clause. Instead of nullifying the sale they simply specified a monetary penalty that would have to be paid by the person who violated the contract.

That means Tesla can sue a bunch of flippers simultaneously, well after the fact. Sure, some of the flippers might have already spent their profits, and Tesla might have to settle for an "IOU", but the advantage is that they can strike en masse, and when they think it will have the least negative impact on their image.

And, no, it's not true that Tesla loses their right to sue others, simply because they were unaware or chose not to sue other flippers. Each case will be decided on the actual merits of that case, not whether Tesla sued every single person who failed to live up to their contractual obligations.

I don't see that Tesla has much recourse as far as recovering that vehicle, but I don't know the terminology in the sales contract. Ferrari is a stickler on such things. If they find that you've flipped one, they won't ever sell you another one. BTW, I don't believe they let you buy a Spyder unless you've previously purchased a coupe of that model.

Law doesn't allow much in the way of remedy for that. The third party isn't a party to the contract. Which is why unknowingly taking possession of stolen property isn't itself a crime, and why they don't have to give it back in that case.

But that's not where the profit went. Tesla wants their vehicles to get used, not sit in flippers' lots. So hitting the source with breech of contract is the thing to do.

I think Tesla is going to do what they do best: make the best BEV's around. Not suing their customers.
