Recently my wife and I were returning from a series of car shows and got sideswiped on the highway.

The other driver was passing us on the right, seemed to be speeding excessively, appeared to be in our lane when he was behind us and may have been following us for some time. We cant say if he was aggressive, under the influence or distracted, but hit us HARD!

Originally we thought it was a ā€œhit and runā€ as the other driver left the seen without a word. Turned out to be a local resident who was quickly interviewed then released from a parking lot. He is claiming it’s our fault and has filed a claim. The video seems to show otherwise.

Anyone else had problems?

I’m guessing we need a good lawyer familiar with Kansas. Thoughts, recommendations? Anything would be greatly appreciated…we are very shaken and car shows are over.

Generally I don't think you need a lawyer in these situations. Just go to your insurance company and provide them with all the information you have, and the video. They will take care of the rest. You may need to pay the deductible to get the repair sooner, but you will be reimbursed once the claim is closed.

To me it looked like a cut and dry, unsafe lane change by the other driver.

1. Don’t give up on the car shows, that clown could have been coming from McDonald’s. Better off giving up on driving on public roads.
2. Video says it all, his insurance will quickly settle out of court. Save video to a flash drive you never want back and provide it it to the police. He will get an improper lane change ticket at the least.
3. File you own claim against his insurance so they repair the damages.
4. File a suit for lost value damages now you have to check yes to the box ā€œwas vehicle in an accident ?ā€
5. I’d sue for lost wages, emotional distraught, lost time for having to deal with stupidity.

the video doesn’t show the driver, could have say it wasn’t them driving, But idiot needs the police report to file claim thereby implicated himself as the driver. You got it in the bag.

If you haven't yet preserve the original video. It should be higher quality than this phone capture.

If you didn't save the video pull out the USB drive now and use a file recovery program to try and get it back.

I just had this scenario happen twice (minus accident) on the way home today.
First was on a three lane toll road. Speed limit 55. Most are cruising at 65-68. I’m in middle lane and orange lifted Bronco (possibly Raptor) passes me on left and miraculously didn’t clip me. They did stay in their lane though. So my assumption is that they were looking at CT through mirrors w/o paying attention to their own lane.

Then after my exit, I’m in the slow lane of a 35mph residential road and a box truck does the exact same thing. I may have to rethink my planned wide-wheel setup because the margin of error lately has been non-existent.

I thought so at first but I think its just the way the video plays back sometimes. click "play" several times in a row and you will see speed stays consistent and its the video playback thats making it look otherwise at times

Agree with what others said. Send to insurance (they will be on your side here) and send it to the police.

Iā€˜m sorry that happened to you. Unfortunately, I know this far too well. For this happened to me twice. Hopefully, not to my CB when it comes in. For sure, you were not at fault. The law of the land dictates if you’re in your lane and another vehicle comes into your lane it is other other personā€˜s fault. Definitely, send that video to your insurance and let them handle it. Furthermore, file a police report quickly. Insurance company will need this too. Added plus to filing is the other person will get a ticket. Even though it won’t make the damage on your CT go away, but you will feel a little better.
