Situations like these, be more mature and let the jaywalker go! I hate people breaking the law and not using common sense but it's not worth our time. We've better things to do.

Sigh. What Defense?

If I got out of my car and beat the living snot out of this guy for kicking it, that would be a battery and an assault ...
...And Vancouver cops would've hauled you off period. No tort, they're pretty serious about it.

Technically the same goes to the Cybertruck driver blocking the crosswalk. Shoulda ignored the truck, too. But it's not like the truck was harmed.

I would say that pedestrians ALWAYS have right of way, simply because you are the one with the big killing machine, and are pretty much in charge of their life. Plus, who would kick a Cybertruck? It has recording cameras everywhere, so you'd clearly be in the wrong, and your foots gonna hurt. It was probably last-second decided. My piece of thought.

You’re never allowed to intentionally plow into a pedestrian just because “I got the right-of-way!”

Of course, there are collisions where you would not be at-fault, like when a pedestrian steps into your path leaving you no time to stop.

Kick my truck all you want. Don’t forget to punch a brick wall on the way home.

I suppose you're right. Sorta like a mix between insurance fraud and suicide?

kinda unrelated, but I've seen other replies that are just empty like this, is there a reason...? Maybe an unsupported format or smth?

Respectfully disagree. In charge of their life? How about some accountability for their OWN life? If it’s not safe to cross, don’t! Roads are primarily for vehicles, not pedestrians. I don’t care about pedestrian rights laws; if I don’t think it’s safe to cross, I don’t. That includes busy crosswalks where the sign says “don’t walk.” Cause pedestrian rights laws don’t mean squat to the laws of physics.

Having the right-of-way does not imbue the pedestrian with a magical shield to fend off injury.

Conversely, a driver with the right-of-way is not immune from prosecution when there’s a body on the hood.

Be careful out there, kids

My "Common Sense" comment was meant for the driver. He should have slowed down like other cars way before the crosswalk.

I would say that cars ALWAYS have the right of way. It is much easier for a pedestrian to stop before walking into a car than it is for a car to stop before running into a pedestrian walking onto the road. That's like saying cars should have right of way over a train.
