This isn’t political per se. but as we all know, all of our cyber trucks have had a rapid depreciation due to the non Tesla related antics of its CEO. If I’d have known this is where we’d end up, despite the fact that I love my truck, I wouldn’t have bought it. Now I can’t get out of it because it’s worth less than I owe. Curios if any attorneys on here think there is a class in the making.
Paid cash, plan to hold till I die, no problem. Santa will out live the Buttheads! Love life!

The same crappy Foundation on Carvana with 25k miles in 11 months for $85k hasn’t sold for over two months.

Asinine, at this rate it should be listed at $78k or less but all the money hungry dealerships are bleeding the turnip for all they can.

I don’t know about anyone else but I don’t know what other car I can enjoy as much as i enjoy this truck!! I make shit up just so I can go run an errand in this truck. So needless to say , I don’t care about depreciation because I am not selling anytime soon. Regardless of what you think on Elon and Tesla they make a hell of car and I will tell any rashional person who will listen.

I do. It’s legally “colorable.” (Look it up.) The CEO and board members have fiduciary responsibilities to Tesla and any third-party beneficiaries (stockholders and such). A case can be made that they haven’t fulfilled those duties. Can that case be made solely as a result of your depreciation? Almost certainly not.

The totality of the circumstances, however: the stock price, the avoidable vitriol, the unusually high devaluation of used vehicles, loss of economic value/infeasibility (such as has been seen by @cyberdriversed), the increased security risks faced by us all are unprecedented, unusual and becoming untenable, and could form the basis of a claim.

Things are not static, however. Many of the claims that you would need to make and assertions you’d need to prove are tenuous, at best. Values fluctuate, by the time you get to trial the stock and the value of your vehicle could be up and your alleged damages would evaporate. EM and the board would argue that their actions are not the cause of any alleged ill affects you have suffered.

But, there is certainly a line (that almost certainly can only be identified in hindsight), at which causation can be shown and a fiduciary breach/breaches can be established. It’s been found and successfully prosecuted a million times for people who aren’t Elon Musk and he’s not special under the law.

So, yes, not easy, probably not now, but it’s possible and without abatement and/or reversal of the current situation/trends … it’s at least colorable. Perhaps.

So, no, contrary to popular uninformed dumbass opinions - it’s (1) not the dumbest thing that ever has been said, (2) you’re not a buffoon and (3) it’s a reasonable question to be asking under the circumstances.

I’m an attorney and although I am not offering legal advice common sense seems to indicate caveat emptor. Be well friend.

sooo, not the point I made. I’ve asked Tesla to buy the truck back per the ban on selling it within 12 months and they are silent. No number has come back yet. And it’s great that you have plenty of equity, I don’t. And now the truck is depreciating at a rate far faster than it was before. No one could have anticipated what is going on with Tesla re its stock price nor the resell market. And let’s not pretend than non Tesla related actions are having a substantial impact on both.

What exactly are you trying to accomplish? You want to seek legal recourse for the unfolding of reality that deviated from your expectation of it? Maybe there is a crystal ball insurance company that you could have used that would have anticipated your personal ideologies conflicting with that of the founder and CEO of the company that you bought the truck from.

If you like the truck which you admitted that you do, I don't see what the issue is or what you could possibly be trying to make happen here from a legal or logical perspective.
