I had asked to put my FS order on hold and they maxed it out til 2/2025 but three days ago said if i don't take delivery by 9/12 they are cancelling the order.
They did the same to me and my Model Y. The contract says that if they offer you a vehicle you have a small window to accept.

Yup.

Delivery; Transfer of Title. If you are picking up your Vehicle in a state where we are licensed to sell the Vehicle, we will notify you of when we expect your Vehicle to be ready for delivery at your local Tesla Delivery Center, or other location as we may agree to. You agree to schedule and take delivery of your Vehicle within three (3) days of this date. If you do not respond to our notification or are unable to take delivery within the specified period, your Vehicle may be made available for sale to other customers. For new vehicles, if you do not take delivery within fourteen (14) days of our first attempt to notify you, Tesla may cancel your order and keep your Order Fee.

Order Process; Cancellation; Changes. After you submit your completed order, we will begin the process of preparing and coordinating your Vehicle delivery. At this point, you agree that any paid Order Fee, Order Deposit and Transportation fee have been earned. If you cancel your order or breach this Agreement and we cancel your order, you agree that we may retain as liquidated damages the Order Fee, Order Deposit and Transportation Fee, to the extent not otherwise prohibited by law. You acknowledge that the Order Fee, Order Deposit and Transportation Fee are a fair and reasonable estimate of the actual damages we have incurred or may incur in transporting, remarketing, and reselling the Vehicle, costs which are otherwise impracticable or extremely difficult to determine. If you make changes to your order, you may be subject to potential price increases for any pricing adjustments made since your original Order Date. Any changes made by you to your Vehicle Configuration, including changes to the delivery location or estimated delivery date, will be reflected in a subsequent Vehicle Configuration that will form part of this Agreement. The Order Fee, Order Deposit, Transportation Fee and this Agreement are not made or entered into in anticipation of or pending any conditional sale contract.

Tesla basically just told me to either take delivery of a foundation series truck or lose $1000 dollars and place a new order for a non foundation series truck when it comes out.

Is tesla in the right here?
yes Tesla is in the right, you placed an order and you're failing to take delivery of that order. The fact that they let people place the order and then decline to accept it was pretty gracious in my opinion. There's plenty of people that had the ability to order the foundation series but didn't. That's the boat you should have been in as far as fairness goes.

I don’t get this though, because you can order one right now with estimated delivery Oct-Dec for a Cyberbeast. All you have to put down is $250. I did mine today.

I mean that's Tesla's choice to lower the deposit amount. I think at this point they're less worried about having one sitting on the lot that somebody backs out of. Hence the lower deposit requirement.

Tesla has a problem with the Cybertruck. They aren't selling as many as they thought. And people on here will freak out over that fact, but it’s true.

Let me tell you a story about just one of the issues it has.

A friend of mine who drives a Model X and loves it, wanted to trade it in for the Cybertruck. It checked a lot of boxes for them and made sense. They put a deposit on one and ordered the FS. They have 3 boys. Two of them are teenagers and the 3rd is younger.

They went to surprise the oldest boy with the “good news” and he literally said he would not let them pick him up in it. Said it was just a spectacle for people who wanted attention.

Regardless of what you think about that, the truth is, it’s very polarizing and causing issues even within families, whether to actually get one or not.

Then they asked the younger teenager (2nd oldest) what he thought and he said it was cringe.

Funny enough the little guy (youngest son) loves it.

So they’ve actually been forced to hold off now on the order. They haven’t said they won’t get it, but they’re waiting.

Elon’s cult followers are gonna be hysterical at reading this, but it’s just reality. They’re a very normal, (prominent actually), family in the area and the teenagers are good, hardworking kids.

So they’re keeping the X for now and waiting.

Crybabies feel free to start crying….

I don't personally let my kids make my financial choices but to each their own I guess.

I don't follow the confusion. Are you confused that some people didn't order the FS because they want non fs? Or some people have had the chance to buy for a long time and didn't?

I personally got invited to order last year but didn't because FS isn't for me and the order was for FS. So, knowing that it wasn't a non-FS order, I didn't order.

Hahahahaha…..

I understand your viewpoint, but you couldn’t be farther from the truth. 1st off what exactly do you mean by cult? I like Elon with the exception of politics. I think he is a great mind that is changing the world. 2nd. I think since Tesla is selling every single Cybertruck produced at a 20k premium it’s not accurate to say they are underselling them or selling less than they thought. They’ve literally sold them all.
3rd. I have two teenage daughters and a teenage son. I heard the same things when I got my Cybertruck. The fact is though when I picked them up from school that all changed. 80+% of high school kids love it. They said how cool it was, many wanted a ride etc. Now I pick them up from practice, games school etc and it’s awesome for them, overwhelmingly positive.

Get what? That they're sitting on trucks they would rather sell but someone isn't taking delivery like they promised?

Absolutely. You are trying to game the system. You put down $1000 to order a FS truck and are now surprised that they are asking you to follow through?
