I'd say at some point we would exceed a "reasonable expectation" for delivery of a $7/8000 value promise of FSD, and at that point a legal ramification could occur.

What is reasonable IMHO, prob a year which we are approaching in a few months.
This was my main point, before the lawyers jumped in. 1/10th of this vehicles potential life is going to elapse without a major *purchased* feature delivered. Good luck trying to defend that with your T&Cs. Contract law is complicated. We wouldn’t have business law or contract-specializing lawyers if whatever’s on the paper is indisputably durable.

What are we all going to talk about once we have FSD (and it works right)?

Then the same kind of people will flip over to how it's not amphibious, or how the Coast Guard wouldn't let them register it as a boat, or some other ridiculous disappointment.

What I can't figure out is why there are so many people that want to sue Tesla but when Ford says their F-150 is really tough, even when a stray baseball will cause thousands of dollars of damage to it, they would never think of suing Ford for calling that "tough".

And why isn't anyone suing GM when they call their diesel engine a "DuraMax" but then say you can only expect it to last 225,000 miles? And some are done-in at just over 100,000 miles.

If I am reading this thread right. There are no legal ramifications for Tesla selling something that doesn't exist, a truly self driving car without the need for human intervention. They are covered because they have the appropriate disclaimers and no specific times in their agreement.

I have a new business idea. I am selling a device that will teleport you anywhere at any time, only $8000. Right now it looks a lot like a piece of wood, but I will keep you updated on its progress on Twitter... (replace FSD with TeleportBlock™)

You could potentially be successfully sued because all they would have to do is convince the court that you didn't believe your own projections.

Now if you were outwardly delusional, and it was obvious to a normal person, it would be harder to sue you sucessfully. Then the onus would be on the buyer to not be doing business with someone who was obviously delusional.

That's a baffling perspective. Because I didn't see @dalton108 get upset about anything. Given the lame arguments presented against his learned and experienced perspectives, he had every right to be upset. But he maintained his cool and shared his knowledge.

What's funny is the way people completely ignorant in contract law, and lacking what should be common sense, pretend like he doesn't know what he's talking about.

Must be a combination of the new entitlement, wokeism and lack of critical thinking skills that has infected people these days.
Maybe I responded to the wrong poster. If so, my apologies to all.

I waited over 3 years to get FSD on my Model 3.

I've had 4 Teslas in the last 4 years with 3 of them performance models. Didn’t buy FSD with any one because it stays with the vehicle. Get the $7500 credit, and trade before it needs $1800 in tires. I floor it every time possible.

Well, I’m an attorney. I’m not going to provide you legal advice over the interwebs, but, I’ll tell you what I’m going to do:

I’m going to be “Actually” Incredibly Patient (AIP™️). I’m going to remember that I bought this car full well knowing that it wasn’t coming with FSD and several accessories that were part of my purchase price and that I both acknowledged and consented to that state of being at the time that I sent Tesla money.

I’ll just go ahead and remember that no date of delivery was promised to me for these accessories and FSD and then just wait patiently until Tesla hands me my FSD and ASS after they deem it’s ready to be distributed to the public rather than wasting a whole bunch of time, energy and money only to have my ASS handed to me in court.

Because, I’ll know that when Tesla is doing the calculus as to whether they’re going to rush a product out so that someone who was given no firm date of delivery at the time of their purchase is investigating whether they should file a pointless lawsuit vs. rushing out potentially dangerous software which will do both financial and reputational harm, that they’re going to ignore the former and focus on the latter 100% of the time.

I’ll recall that I haven’t lost a single dollar because of this “delay,” since, I got exactly what I bargained for which was: (1) a car today and (2) some other shit at a unspecified later date.

I’ll remember that no matter how earnest or wildly inaccurate any promises or statements Elon made outside of the four corners of my signed agreement are, that those promises aren’t worth the electrons they’re printed on since they don’t modify my contract. ??‍♂

But again, that’s just what I’m going to do. You should do what feels right to you.
You know that feeling like you were anonymously black until...

?

Hiding in plain sight in the first picture I ever posted here. Sitting on the tailgate of my beast - next to my: plaid, c8, fj and y - flying my drone.

Now, other than continuing to assume [all evidence to the contrary] that I’m a very unsuccessful pretend lawyer, they’ll suppose that I must do criminal law, if anything. ?

As predictable as it is pathetic.

? the attorney is going to laugh at you. What are your damages???
I’ve been incredibly patient thus far, but if September comes and goes without FSD, I’m going to speak to an attorney and see what my options are. Most of the value of Founders Edition was in the FSD capabilities. So, I figure if the usable life of my truck is 10 years with FSD valued at $12k, we’re all down $100/month every month FSD slips. We shouldn’t tolerate this.
