If anyone in the Los Angeles area is interested I got my Founder’s Limited Edition email tonight. Problem is I just finished a major home renovation and unfortunately can’t justify a $100k+ truck purchase right now, so I’m looking to sell to the highest bidder.

Delivery says Dec-March. I’m open to ideas, but the best option I’ve seen so far is to create an LLC. I buy the truck under the LLC and then transfer the full ownership of the LLC to you.

Obviously the LLC truck purchase would need to be funded by you for me to be able to make the purchase. You can of course come on delivery/pickup day

If it's even possible, i think you would have to engineer a safer mechanism for the buyer. Since the buyer has to give you the money to make the purchase, what guarantees that you will then transfer the LLC to the buyer. What recourse does the buyer have if you refuse to sign over the LLC and truck?

Best you buy it with your money then sell it thru an LLC?

A question for discussion. Maybe someone knows, how does transferring a new vehicle affect the Government's EV tax credit?

If the original buyer qualifies for the EV tax credit are there any ownership requirements to receive the credit? Do you have to keep the EV for a certain amount of time, or can one get the tax credit at delivery and then transfer the vehicle immediately?

I would think the tax credit in NOT transferable.

Just set up a legally binding agreement before the deal.

Tesla will somehow thwart your 'plans of mice and men'......

that’s gonna get you audited by the IRS. On their website, they explicitly state you cannot use the tax credit if you resell the vehicle.

To qualify, you must:
  • Buy it for your own use, not for resale
  • Use it primarily in the U.S.

Yeah I wish I could! I’m totally tapped at the moment, cash-flow wise. Obviously would need to start a business relationship with this person. Draft up legal contract etc to cover as many scenarios as we both could think of.

I did, hence the work-around.

As a fail safe I could always “add driver”. I need to research my Liability in that scenario.

Yeah that’s exactly where I’m at right now in the analysis. Looks like my market is limited to LA if it were an “Add driver” scenario.

Also need to assess criminal liability if it’s on my account too. The LLC is a better idea, but not sure if Tesla will let me buy under an LLC or not
