It's not like Musk/Trump are making themselves popular in China either. Tesla may be in far greater jeopardy there because they hold the mortgage on his factories and their courts aren't going to object to any government confiscatory actions. :rolleyes:

There's long been a rumor they're going to rendition him to China but I don't think it's likely they'd retaliate against Musk specifically.

The arbiter is the “reasonable person” standard. A reasonable person, at law, is an “objective standard” it is not “subjective.” It’s what we lawyers call a “term of art.”

It is not based on the defendant’s actual mindset (subjective), but on how an ordinary person should have acted in the same situation (objective). When the dust settles, there will be Monday morning quarterbacking and your life/liberty may be on the line!

A “reasonable person” exercises average care, skill, and judgment in conduct and decision-making, as required by society, to minimize risk and harm to others.

You’re not living in an action movie or video game. Everyone around you is a real person with the same inalienable rights as you have - not an NPC - and you don’t get to kill them (without consequences) because you felt unreasonably a-scared. Nor are you Judge Dredd!

You guys have four (by my count) unaffiliated lawyers, now, all telling you how this works - on this one thread! Do what you think is prudent. ??‍♂

But, if you decide to make a mess of your life, don’t say you weren’t warned.

This discussion can last for weeks. There are so MANY variables. The "alleged" assailant has clinched fist, so he must be angry, right? Or, is he handicapped with rheumatoid arthritis and terrets?

Is he bigger than you, does he look like a professional boxer as he advancing towards you after you have warned him to stop, then he suddenly reaches into his pocket... You make a split-second decision, only to find out later he was retrieving a preprinted card announcing he was DEAF and MUTE.

Does he have a knife? Look up the "21' foot rule" and determine how far and how fast you can retreat as he is approaching? IT ALL MATTERS! Just know, if he is a wrestler, mixed martial arts trained, or even just younger and in better shape and he gets his hands on you.... even without any other weapon, nothing good will happen for you.

IT ALL MATTERS! What about your state of mind? Why did you feel a need for a CC? Do you like shoot 'em up movies? BTW, did you just have a fight with your significant other? Do you drink? Why are you always angry and posting crazy S#!t on social media?? Or are you just a decrepit old, retired guy that just bought a Cybertruck? Yep, that matters, too.

Like I tell my kids.... life is about choices and choices have consequences. MAKE good choices for the right reasons. Finally, always remember it is better to be tried by twelve than carried by six (though maybe not easier, just ask Daneil Penny). Hopefully, we all make the right call. *

I was going to start a thread about the incident in this video when I saw this thread. In my case, it almost was assault with a deadly weapon. I probably will start a new thread, because I don't want to hijack this one... but it does support OP's experience!

I won't entertain whether I was right or wrong - not looking for comments here either as I'll start a new thread. I've run it past two police officers and knowledgeable friends. With the full 10 minutes of video prior to this, knowledge of the highway and three plow operations, I'm confident that this is on the plow driver. Other Tesla owners immediately jumped to Cybertruck Hate, and I'm now agreeing. Crazy what triggers people.

Looks like he just wanted to get a closer look like everybody else trying to get a closer look at the CT almost crashing into it. ?‍♂

Not really you have the answer from two practitioners (not 1Ls). I’m sure all of the potential permutations seem daunting/confusing to a layman or a brand new law student. It should! That’s why you and they are not allowed to practice law. We are. We’ve earned the right and demonstrated our competence.

OP is doing this every day. AZ-CT told you that he’s a criminal defense lawyer. Sefar is a lawyer and has his CCW. I teach martial arts, have my CCW and know a little about fighting and the law.

We are lawyers. The one thing you can be damned sure about - if there was something to debate, we would be debating it. ?

But as a said, take your own counsel and enjoy the ride. I’m sure you know better. Just don’t be surprised. Turbulence ahead. ??‍♂

I am so glad I ran into this thread as I thought it was only me.

Driving a Cybertruck today is a sociological experiment in human psychology as it brings out the weirdness (rage? unresolved issues? fear?) in people. Long story short, at my college that I teach, a student was suspended for writing "fag" in the dust on my truck. You would think Gen Z, or whatever college students are today, would know these trucks have cameras everywhere. Weeks later when I found the guy, I asked why he did it. His response? "Cause its faggoty f%$king stainless steel." He was troubled and was triggered by a Cybertruck.

Yes, I have been flipped off and sneered at, though, to be fair, the intense love for it by some is as intense as the hate. Damn. It's just a car. I swear I just watched the window break in 2019 and decided I wanted one at that moment. No politics. No conspiracy. No statement. It's just a dynamic, different, excellent vehicle.

But that doesn't explain the constant blasting of his horn... ?

It's very interesting that Cybertruck hate in the US seems to be typically blamed on left of center politics. Up here in Canada, it's exclusively (and I do mean exclusively), the far right idiots with "F*ck Trudeau" stickers on their pickups. I can easily see the driver of this plow returning to the yard and jumping into his truck with that sticker stuck to the back window.

It makes me think that there are regional triggers to consider...

As Gerry Spence says, nobody escapes the price to be paid for taking another life. I have seen hardened police officers weep openly on the stand when recounting what they had to do. Much like the fellow from yesterday, I have compassion for you my friend, but certainly not empathy.
Agreed! I had a client where the jury acquitted both he and his brother for allegations including murder. I’m glad the jury got it right, but the effect on someone for being forced to take a life to save your own is hard and heavy, and it never goes away. At the least it is a lifetime of mental health issues that you would not have had.

I’m glad the jury got it right, but the effect on someone for being forced to take a life to save your own is hard and heavy, and it never goes away. At the least it is a lifetime of mental health issues that you would not have had.
If it's legit, it's improving society (no recidivism among the dead). Guilt over that is wasted.

And add salt to that wound by having to pay a lawyer 10’s or 100’s of thousands, upfront.

Damn dude. I never really think about the realities of your line of practice. I can tell the difference between war stories and supposition, though. Brutal!

Boys, I’m telling you this is one that you want to not learn the hard way. Criminal lawyers do not work on contingency.

Three stories happened over the last couple of days.

1. Yesterday, a 20teen red Mustang pulled up beside me at a light. Window rolled down. I rolled down mine. The driver was an older white lady with a Marlboro Red dangling from her lips. She yelled, "That thing is so cot damn ugly!" Without skipping a beat, I replied, "it's like black licorice... you either LOVE IT! Or you fuuuugging HATE IT!" Her hubby in the passenger seat started CRACKING UP!!!! Light turned green just then....me "But she's fvcking fast!!!" Beast Moded out of the hole! Never saw them again.

2. A Latino gentleman pulled up beside me at a light in a slightly lifted F-250 (big truck). So I raised my Beast's suspension to high. He saw it. Rolled down his window, laughed, and said "I WASN'T EXPECTING THAT!!! I really like these things!" I said, "I saw you lifted there beside me and was like "oh hell no!" lol". Him: You like it? Me: Honestly, love it. [had FSD on...light turned green] Me with hands in the air: "...and it drives itself!!!!" FSD did what FSD does! Highbeam flashes from my new friend in my sideview mirror.

3. A friend and a friend of a friend were going to walk home from a get-together. I said, you wanna go for a ride in the UFO instead of walking? Sure. Did the usual walk around. Did a Light Show. Hit the road. BLEW. THEIR. EFFING MINDS with a couple launches. Got them to the destination...friend of the friend, never met before looked me in the eyes, super serious, and said..."dude. I REALLY appreciate that." I just chuckled and said "No worries brother." Him: "No seriously. Thanks." I thought he was going to propose or something. ?

I don't get much hate. But I'm in a Red part of town in a Red State. ?‍♂ Jussayin'
