not a lot of conversation/speculation around this because it seems patently wrong and not much worth talking/speculating about
I believe you are correct. On the IRS website the MSRP includes manufacturer installed options, accessories, and trim:

“ In addition, the vehicle's manufacturer suggested retail price (MSRP) can't exceed:

$80,000 for vans, sport utility vehicles and pickup trucks
$55,000 for other vehicles
MSRP is the retail price of the automobile suggested by the manufacturer, including manufacturer installed options, accessories and trim but excluding destination fees. It isn't necessarily the price you pay.”

only people who don’t understand the IRS regs/guidance could possibly think these Foundation units would through some shenanigans be treated by the IRS as costing only $79,990

add floor mats at configuration and it busts the IRS MSRP cap

meanwhile, the “Foundarion” package is a $20K trim package that ‘rides’ over the base AWD trim package

just like a Lightning’s Platinum trim package rides over a Lariat ER’s trim package


it doesn’t matter that a person *could* but the Lightning’s Platium wheel/tires later from a dealer - it only matters that they’re included in the trim and it’s pricing

put differently, there’s zero rational reason to talk about whether the IRS would view a Foundation unit to not involve an extra $10 of qualifying MSRP

If it is wrong, don't try to add ANY options to the AWD when it comes out as it will then also be above the $80k limit.
that is exactly correct

this is how the entire credit paradigm works


I’ve only just realized that perhaps Tesla folks are in general a bit less agile with the new regs, because Tesla had for so long been out of the money for these credits

those of us who lived through buying a Lightning while the regs were in flux, are pretty well seeped in it

What is unique or special about the Foundation Series is that it is actually the Beta Series. Tesla could not call it Beta Series and put special Beta Series laser engraving on the Cybertruck and have people feel good about purchasing for the extra money. This is fine as we should be thankful that people are purchasing the Beta Series to iron out the problems and headaches so Non Beta Series owners will not have to deal with the issues.

We’re all beta testers as it relates to pretty much any technology. New or old.

if companies waited until every kink was worked out in their tech before they launched it, nothing would be launched.

personally I welcome the beta testing. I’m stoked to get the CT FS and rally the shit outta that mofo!

Let’s see what it can do!

Its has vision FSD (that doesn't work right now) - that will always be a part of the Foundation series and so even if you bought a used one in a few years, it will have it.

On a side note, I'm totally unconvinced that Tesla will "honor" the $7,000 FSD lock-in price. My recollection of the fine print was that some people back in 2019 said the FSD price may still be subject to revision based on future higher level capability of FSD or some other such silliness... Anyone remember scuttlebutt about that?

We've had this conversation before: It would invite civil and possibly criminal charges in California to alter a promotion like that. Our advertising laws are often vague, but when it comes to promotions, advertised prices - we're draconian.

The test is 'would a reasonable person think this is the same thing?'

And that's yes, yes a reasonable person would think that FSD is the same FSD they were 'locking in' the price of.

I'm mostly just trying to get a list of everything you should get but yes, many of the items have dubious dollar values. You are forced to pay max retail. Even the $3000 for the tires sounds high, the truck would still come with tires but $3000 more just for different ones? I do not like how Tesla handles FSD, it doesn't work yet, it's $$$, if you lose your car you have to buy it again when they could just move it to a new car for a small fee or for free, and tell you it is not worth anything on a trade-in.
