I'd like to point out that the SORB test (Small Offset Rigid Barrier) that absolutely obliterates vehicles is conducted at only 40MPH. The above shows nowhere near that level of damage, so the truck was moving slowly (or slowing) at impact.

If it was the result of the cover slipping and getting stuck on the firewall I doubt it would have unstuck itself and reattached, the cover would have to come off completely to release the pedal. The vehicle would have tried to accelerate again once you let off the brake if the pedal remained stuck.I originally stated it as a brake malfunction, the more i explain the situation and with the recent stuck accelerator recall, if the accelerator was stuck could explain why the regen was delayed...
Reduced regen is "normal" operation if the pack is cold enough and/or high SOC so that may qualify as "operating properly" in their eyes.I have received back from tesla on their diagnostic, that the vehicle was operating properly at the time of the accident...
